against
Dr Les
Sachs, that forced him to take refuge in Europe
Below is the full text of the 3rd
of
April 2004 court filing, originally made from Amsterdam, the
Netherlands, and
filed
with
USA
4th Circuit of Appeals Chief Judge Wilkins, exposing the Jew-hating
crimes
of Patricia Cornwell and the US government, in their threats of murder
and attempt to ban the journalism of Dr Les Sachs.
It is specifically a judicial
misconduct filing, and that is why U.S. federal Judge Robert Payne is
named in its header, though the court filing details the entire
scandal involving President Bush's friend Patricia Cornwell, Penguin
Books and numerous other criminal
parties. This is the document extensively shared among federal judges
and even the members of the new judicial ethics panel named
in May 2004, headed by US Supreme Court Chief Justice Stephen Breyer.
The federal judges, America's FBI, and Patricia Cornwell and her whole
gang of lawyers and crimimal thugs, do not deny that this court filing
accurately exposes felony crimes by Patricia Cornwell and her gang, and
that these are impeachable offenses by US federal Judge Robert Payne.
But they
refuse to make any official response, choosing (so far) the path of
stonewalling and cover-up.

This court filing is a little difficult to read, as it is an emotional
document written
by Dr. Sachs in
his last days in
hiding inside the USA, as he was living under direct threat of U.S.
government jailing and murder by Judge Payne and the
Cornwell thugs. This document reflects
the emotional trauma of Dr. Sachs as a victim of USA political
and judicial terror. Allowance needs to be made for the
circumstances of mortal fear in which it was written.
The document also has many quotations that accurately display the
vulgarity, obscenity and bigotry of America's lawyers and judges, as
Dr. Sachs witnessed and experienced it in his long struggle. It is not
a pretty sight. But everyone should understand the crass
nature of the legal figures involved in this scandal.

extortion, terrorism, and treason against the United States

criminal
scheme financed by Republican and George Bush Government campaign
contributor

Judge Robert Payne, or be guilty of increasing the international
disgrace of the USA legal system, as the sleaze, fraud, farce and
debauchery of the Patricia Cornwell – Judge Payne "phony show trial"
scheme is exposed to the entire world.
Documents prove USA Federal Judge Payne staged a bogus, phony,
fraudulent, sham, kangaroo, “Joseph Stalin Moscow Style” farcical
political court proceeding, Judge Payne hiring known felonious thugs to
fraudulently pose as a victim’s lawyer, Judge Payne’s thugs then using
threats of illegal jailing and murder – proven in writing – to enact a
political farce to deceive the entire American people, and permanently
damage the USA Constitution – Judge Payne’s criminal thugs paid by
federal bribery funds supplied by the weird right-wing extremist
Patricia Cornwell.
Documents prove USA Federal Judge Payne procured known felonious
criminals who threatened to illegally jail and murder an American
writer and journalist, and that Judge Payne’s thugs imposed a campaign
of criminal terror to prevent an illegal and unconstitutional order
from being appealed.
Documents prove USA Federal Judge Payne improperly acted as judge in a
case with known criminals with whom Judge Payne is personally involved,

Judge Payne’s thugs used threats of violence, torture, murder and

Judge Payne, his criminal thug Thomas Roberts, and their bogus,
phony, non-existent and feloniously fraudulent “First Amendment charity
foundation”, a felony fraud which is still carried on by Roberts in
written
form on the internet - Shocking relationship between Judge Payne and
the
criminal thug Roberts who helped him stage the fraudulent phony court
proceeding.
Judge Payne’s phony court proceeding needs to be recounted in every law
school in the world, as the textbook example of the unlimited evil
that results from a ban on freedom of speech, as Judge Payne’s brutally
illegal court order instantly led to the commission of a long series of
felony crimes under cover of this order, the order was used to hide
threats
of terror and murder that prevented the order itself from being
appealed,
and was the tool of political fraud of the entire American people.
Judge Payne quoted as admitting to “bending” the USA Constitution as a
“reward” for campaign contributions, legal fees and bribes paid
by America’s uniquely lesbian right wing extremist Patricia Cornwell,
the vulgar Judge Payne speaking of his willingness to provide “a little
service to our dyke bitch Cornwell, with all the money she’s paying us
here.” Judge Payne is quoted as declaring his goal to “keep the money
flowing” from Patricia Cornwell to the Bush campaigns and right wing
politicians,
and that is why he is illegally banning the journalism of a critic of
Cornwell.
Right wing extremist Judge Payne, quoted in anti-gay, anti-semitic, and
racist remarks, also quoted as admiring Nazi Reich leader Adolf Hitler,
and Judge Payne adopting pro-Hitler values on the court record, Judge
Payne supporting bookburning, the banning of free speech and
journalism,
quoted as laughing at the memory of Holocaust victims, denying right of
trial by jury “because the jury might like the f-cker, and won’t do
what
we want”, Judge Payne following Adolf Hitler and Joseph Stalin in
denouncing
independent writers and journalists and intellectuals as “dangerous
f-ckers”
who need to be suppressed, Judge Payne giving support to the planting
of false evidence, the nazi-style use of right wing propaganda, and the
political use of bribery, fraud, extortion and corruption by America’s
crooked lawyers, Judge Payne making astonishingly false statements to
protect
the Patricia Cornwell gangsters.
With hilarious irony, Judge Payne helps Cornwell’s own lawyers to
defraud Patricia Cornwell herself out of several hundred thousand
dollars, Judge Payne using court power to cover up for the criminal
scheme, while Cornwell’s lawyer Shumadine is quoted as bragging that
the right wing
millionaire Cornwell is “a totally stupid lesbian whore” and “I can
milk
that bitch like a fat f-cking cow.”
Judge Payne’s thug Roberts, totally unquestioned by state and federal
authorities who are fully aware of his crimes, is walking around
telling people that Judge Payne is fully backing his felony criminal
activities, and that no one can take down Roberts without taking Judge
Payne down as well, and this won’t be done because they are also backed
by the President Bush USA government that gets campaign money from
Patricia Cornwell. Roberts is right in that his own indictment can lead
to Judge Payne’s impeachment. And USA Attorney General Ashcroft needs
to say whether he’s cutting a
deal to cover this Patricia Cornwell – Judge Payne – Thomas Roberts
scheme
of fraud and treason.
Thousands of USA lawyers are also aware of the Patricia Cornwell –
Judge Payne scheme of extortion and treason, acknowledge that Judge
Payne “did a dirty deal” in collusion with Cornwell’s lawyers, agree
that it should lead to the immediate impeachment of Judge Payne and the
indictment of Cornwell and their thugs, but lawyers are either driven

judges and the US government if they become “the lawyer who tries to
fight a crooked federal judge that’s backed by the Bush government”.

purchase price of campaign contributions and bribes, with a judge

8. The half-million dollars spent to fund this scheme of USA federal
court fraud and treason, was supplied by the world famous celebrity
crime author Patricia Cornwell, who has leveraged her $125 million
fortune into a unique position of political power and influence via
right-wing Republican campaign contributions, her influence centered in
the crooked state of Virginia, perhaps the most notoriously corrupt
region in the entire USA,
where even former judges, like Judge Katherine Howe Jones, acknowledge
judicial
bribery as commonplace.
9. Patricia Cornwell is a lesbian who is full of pain and self-hatred
about her lesbianism, perhaps stemming from her conservative Southern
origins. Patricia Cornwell’s ambiguity about her own lesbianism, and
dislike
of her own femininity, has led not just to her dressing in male
clothing, but in an extremely bizarre pursuit of mannish-ness, which in
Cornwell’s mind means the right-wing fascist-style pursuit of political
power. So Cornwell has become a major funder and campaign contributor
of America’s right wing Republicans, including George Bush, Senators
and Governors, despite
their anti-gay politics, a funding which in turn buys Cornwell a
private
political power and the ability to get away with criminal acts when she
so chooses. The former Republican governor of Virginia, Jim Gilmore,
has
actually been living in Patricia Cornwell’s house and sleeping in
Cornwell’s bedroom, the same bedroom where Cornwell trysted with her
lesbian lovers.
10. Patricia Cornwell is bitter and lonely in the trap she has
built for herself. Her lesbian contacts will tend to despise her for
her association with right wing and anti-gay Republican politicians.
George Bush, Jim Gilmore, US Senators all are glad to take Cornwell’s
money,
but at the same time despise her for being a drug-using lesbian. Judge
Payne himself is quoted as expressed this ambiguity even while joining
in
this scheme with Cornwell, saying, as quoted by Judge Payne’s own thug
Roberts, “In a way I hate to help out Cornwell, she’s such a slimy
lesbian c-nt,
and her writing is such a load of crap, but she’s given enough money to
the
Right political people, and she’s made our boy Shumadine [Cornwell’s
oily
Virginia lawyer] pretty well off, so we need to give a little service
to
our dyke bitch Cornwell, with all the money she’s paying us here.”
11. Patricia Cornwell’s self-hatred has taken routes of others with
similar mental problems, like Adolf Hitler. Cornwell is recognized by
her own lackeys as a habitual user of fancy illegal drugs that she can
easily afford. She has a Nazi-like obsession with ghoulishness and
death
and the quest for power, and she is driven to seek and play games of
power
in a nazi-style manner, now having entered upon the extremely high
crimes
of federal court bribery, hiring thugs to threaten to murder people,
the
political purchase of the banning of another writer’s freedom, and the
ultimate
crime of all: felony treason to do permanent damage to the USA
Constitution
and government. With her self-hatred and personal problems, Cornwell
takes
a thrill in large scale crimes of fraud and power.
12. Cornwell is recognized by her lawyers, publishers and handlers as
an extremely damaged piece of goods. In person, her mental problems
easily display themselves, and she can be the raving, babbling
semi-lunatic. In her professional writing life, a principal earmark of
her later works has been a pattern of instances of theft, plagiarism
and downright verbatim copying of outside material. The biggest crime
she committed before entering upon this scheme of treason, was
Cornwell’s violation of the corpse and privacy of a murdered child,
Cornwell thieving the autopsy account and real
life facts of a murdered child’s death, and putting it almost verbatim
into
a novel, without request or compensation to the grieving family.
Cornwell was sued for this reprehensible crime, and was decreed by
experts to be a plagiarizer, but the lawsuit against Cornwell
mysteriously disappeared when,
according to other Virginia lawyers like Scott Crowley, Cornwell’s
slimy
and oily Virginia lawyer Conrad Shumadine was able to successfully
influence
and bribe the judge to dismiss the case on a technicality.
13. With her long residence in right wing Virginia, her long pattern of
campaign contributions to Virginia’s leading politicians, her
connections to lawyers who are regarded as experts in local judicial
bribery, Cornwell got very used to the idea that she could commit just
about any crime
and get away with it. As one Virginia lawyer puts it, “That rich c-nt
Cornwell could f-cking kill somebody in Virginia, and no cop would
touch
her.” Confronted with blatant instances of plagiarism and copying of
outside material for her books, Cornwell quickly chirps, “That wasn’t
‘based on’ that material, it was just ‘inspired by’!” as if that
explains
it all away. Known as a slimy character generally by people who have
contact
with her, she is a plagiarizing writer in an entertainment industry
with
a reputation for being full of plagiarism.
III. Background of Dr. Les
Sachs
14. More information about Dr. Les Sachs, and a brief biography
and photographs, can be found on the DrLesSachs.com website. Dr. Sachs
is one of the most highly educated individuals to have ever lived in
the
United States, with seven degrees from three universities, his degrees
are in philosophy, education and religious studies. Dr. Sachs has never
been concerned with making money, despite the lies and propaganda of
Judge
Payne and the Patricia Cornwell gangsters. Quite obviously there were
many
routes to making money Dr. Sachs could have pursued after Harvard,
which
he passed up to focus on a personal intellectual and spiritual journey.
Dr. Sachs was also a USA government employee in his youth, and holds
the
Superior Performance Award from the US Department of Justice for his
work
there.
15. Dr. Sachs has a little Jewish blood in his heritage and is a
distant kin to some of the victims of Adolf-Hitler’s Holocaust. As a
young
student, Dr. Sachs won Voice of Democracy and American Legion awards
for
a speech he wrote and gave on the topic of freedom. While still a
teenager, Dr. Sachs developed very strong anti-fascist views, in favor
of freedom
of speech and against practices like bookburning and legal corruption.
At
Harvard, Dr. Sachs helped to teach a course on the permanent relevance
of
the history of the Nazi Reich, and how all of us must oppose nazi-style
and
fascist activities whenever we find them.
16. Dr. Sachs is a writer whose style and views and opinions are much
liked by the American people. Dr. Sachs became a nationally popular
author with a book he wrote for the Penguin Putnam corporation, a book
of new-style journalism exposing the sleaze and farce of the American
auto sales industry, a book which CBS television and others declared to
be the best book of its type ever written. This book is what first
enmeshed Dr. Sachs with Patricia Cornwell’s publisher Penguin Putnam,
and is what made Judge Payne and the Cornwell gangsters so anxious to
impose a lifelong ban on Dr. Sachs’ journalism about Patricia Cornwell
and legal corruption. They knew that Dr. Sachs could expose the sleaze
on these topics, just as
thoroughly as he did that of the car sales game.
17. The records show that, in contradiction of the claims of Judge
Payne and the Cornwell gang members, Dr. Sachs has in fact not been a
seeker after publicity, and instead has preferred the life of a quiet,
fairly unknown writer. Dr. Sachs turned down numerous opportunities to
be on television and radio in connection with his successful car book.
Dr.
Sachs enjoys writing and expression, but has sought neither wealth nor
publicity, and instead is someone pursuing spiritual and intellectual
goals
on a personal level.
18. At the time the Patricia Cornwell – Judge Payne scheme of fraud and
treason was enacted, during the 2000 George Bush election campaign, Dr.
Sachs was still living very modestly. He had no wealth or liquid
assets, worked happily at a humble job living paycheck to paycheck, he
had no
significant money for legal fees, and no motive to “settle” and to
refrain
from appealing Judge Payne’s laughably illegal court orders, other than
the threats by Judge Payne’s thugs to illegally jail, torture and kill
him.
19. Not long after Judge Payne and his thugs enacted their scheme of
terror and treason, as Dr. Sachs came to think he did need large
amounts of money to fight for freedom and the Constitution, Dr. Sachs
quickly became one of the highest wage earners inside the USA. Dr.
Sachs used his compassion and talents to become one of America’s most
successful mortgage loan officers, with a cash flow of several hundred
thousand dollars he could use to pay for lawyers. He found, however,
that in the current USA climate of legal corruption, USA lawyers are
too afraid to confront a criminal scheme in which evidence shows a US
federal judge to be guilty of misconduct, lawyers fearing revenge by
other judges, their voices trembling in fear as they cite the need to
“play The Game” in order to have legal careers at all.
IV. The Two Novelists –
Cornwell
and Dr. Sachs
20. The United States publishing industry largely collapsed and
imploded on itself in the and 1990s. The national focus on
“bestsellers”
meant that publishing companies could make more money by over-hyping
and
over-selling books by a few very well known authors, rather than taking
risks in publishing books by new authors. It is very understandable
that
someone like Patricia Cornwell, who can make millions of dollars now
from any book published under her name, even if such book is poorly
written,
can be desperate for new story ideas, which are extremely difficult to
originate even for talented writers. The half-crazy, drug-abusing,
power-seeking
Cornwell, had already had success in plagiarizing material from other
people, and was able to cover up for this plagiarism by throwing money
into
Virginia’s corrupt culture of legal bribery. In addition, the large USA
entertainment history has a history of hilariously gross plagiarism,
like
the “A Team” scandal. The Penguin Putnam corporation has been
continuing
to make tens of millions of dollars from Patricia Cornwell’s works,
even
though they know she is a dishonest, malicious, plagiarizing writer who
has
sunk into a long creative slump. Penguin Putnam knows it must keep
Cornwell’s
plagiarism, sleazy character, her neo-nazi extremism, and her mental
torments
about her lesbianism, all hidden from the general public, in order to
maintain
their corporate profits.
21. Prophetically, Dr. Sachs’ novel of the 1990s, The Virginia Ghost
Murders, is partly about the theme of Virginia government corruption.
Dr. Sachs completed this novel in 1997 and published it in 1998.
Numerous documents from 1997 and 1998, already in federal court
records, show very clearly that Dr. Sachs’ novel was being read by
Patricia Cornwell’s agents, editors, and personal friends and
acquaintances.
22. Dr. Sachs’ novel, The Virginia Ghost Murders, has an extremely
unique plot developed by Dr. Sachs, in which an investigation into a
hundred-plus-year old murder involves the female heroine with a modern
killer, and the
crimes of the ancient past become part of the key to solving crimes of
the modern present. Well after Dr. Sachs’ novel was published, in
December
of 1999, Patricia Cornwell and Penguin Putnam announced Patricia
Cornwell’s
“new novel”, with a plot in which an investigation into a
four-hundred-year
old murder involves the heroine with a modern killer, and a “face-off
against crime both ancient and high-tech”. Most people agree that these
two plots sound similar, except for US Federal Judge Robert Payne and
the Cornwell
gangsters. Judge Payne spouts the nonsense that there is “no
similarity”
here, and orders that if Dr. Sachs talks about this, he is to be
jailed,
Judge Payne ordering that Dr. Sachs’ speech, journalism and literary
opinions
are all banned for the rest of his life, for the benefit of Republican
campaign
contributor Patricia Cornwell. Judge Payne grinned and smirked as he
declared
his own nazi-like powers to make his personal extremist views, the
basis
of banning opinions by a journalist and writer like Dr. Sachs.
23. After the announcement by Cornwell of a book that seemed to
be clearly ripping off Dr. Sachs’ book, Dr. Sachs began a two-month
period of investigation and letter writing, with hilarious, satiric,
teasing, bombastic letters, sent privately to all the people involved
in Cornwell’s publishing operation. Dr. Sachs teased Cornwell with the
notion that her rip-off would make “great marketing” for his own book.
Dr. Sachs’ goals were to uncover how deeply Cornwell and her gang were
potentially ripping him off, and to embarrass the Cornwell group from
completing the plagiarism. Dr. Sachs thought it was better to try and
prevent Cornwell’s plagiarism in the first place, rather than file a
lawsuit after the plagiarism had been completed, first of all because
Dr. Sachs was not wealthy at the time and so could not afford legal
fees, and secondly because Dr. Sachs already had a sense from the
general news media about the corruption and hopelessness of the
American legal system. Dr. Sachs made himself a genuine pain in the
rear end to the plagiarizing Cornwell.
24. The response of Cornwell’s lawyers and handlers to Dr. Sachs’
satiric needling, was first of all to brag that Dr. Sachs would be
helpless and have no recourse against Patricia Cornwell’s copying of
his material. This boast came from Penguin Putnam Counsel Alex Gigante.
Then, however, Dr. Sachs got some results, as his protests shut down
the great billion
dollar Penguin Putnam publishing machine. Penguin Putnam announced a
four-month delay in the publication of Patricia Cornwell’s novel, while
Patricia Cornwell substantially re-wrote her drafts to eliminate the
more obvious and blatant rip-offs of Dr. Sachs’ novel. But even in the
final published novel of The Last Precinct, published after the
Cornwell extortion and treason and banning of Dr. Sachs’ freedom had
been accomplished, Cornwell still left a trail of several elements
imitating Dr. Sachs’ novel, plus Cornwell modeled the murderer in her
book partly on Dr. Sachs.
25. With Cornwell starting to re-write her own book after Dr. Sachs’
protests, Cornwell’s lawyers, keeping in mind the stupid and gullible
nature of their drug-abusing, half-crazy, half-stupid client Cornwell,
then began taking steps to try to create further controversy and set up
a lawsuit where they could get several hundred thousand dollars in
legal fees from Cornwell. The Patricia Cornwell – Judge Payne
conspiracy of judicial fraud, terror and treason, actually began in New
York City as a conspiracy among Cornwell’s lawyers, as documents
clearly prove. The originators of this racketeering scheme are New York
entertainment lawyer Michael Rudell, whom the stupid Patricia Cornwell
thinks is her “friend”, and Penguin Putnam Counsel Alex Gigante. The
New York lawyers quickly realized that with Dr. Sachs as a Virginia
resident, they could take advantage of the Virginia culture of court
bribery, and use Cornwell’s Virginia lawyer Conrad Shumadine, with his
experience in judicial bribery, to pull off the ultimate criminal
scheme, and earn several hundred thousand dollars in profit while
committing treason against the USA constitution.
26. It is important to realize that Patricia Cornwell is definitely not
the “mastermind” of this scheme of judicial fraud and treason, even
though she funded this whole criminal project with a half million
dollars of her money. Patricia Cornwell is certainly guilty of federal
crimes
– she is clearly stone-cold guilty of felony on-the-record perjury
before witnesses, and she knowingly funded felony criminal acts, and
Cornwell
took great pleasure in engaging in bribery, threats of murder, and
treason
– but at the same time it should be realized that Patricia Cornwell is
also a passenger on the bus being driven by her own lawyers. Even
though
the Judge Payne phony court proceeding was a farce where one side was
paying bribery funds, it also needs to be understood that it is a farce
where both alleged “parties” in the case were being systematically
deceived and defrauded by their lawyers, including Cornwell herself.
Judge Payne’s ultimate loyalty in the Cornwell farce, was to the lawyer
that, as quoted by his thug Roberts, Judge Payne fondly calls “our boy
Shumadine”. Judge Payne’s hysterical
anxiousness to silence Dr. Sachs, was as much for the benefit of George
Bush – right wing Republican politics, as to cover up for the fraud
games
played by America’s crooked lawyers. Judge Payne never wanted Cornwell
to realize she was being defrauded by lawyers Rudell and Shumadine, and
banned Dr. Sachs’ journalism partly to aid Cornwell’s lawyers in
defrauding
Cornwell.
27. The key document in the Cornwell case is the neo-nazi letter
written by Cornwell’s lawyer Michael Rudell, and faxed to Dr. Sachs on
1 February, 2000. In that letter, written to please and excite Rudell’s
neo-nazi client Cornwell, and also to start the controversy that would
lead to Cornwell spending a half million dollars to fund bribery and
treason, in this letter Cornwell and her lawyers demanded total silence
and submission from Dr. Sachs, the self-banning of his own opinions,
and the letter ordered Dr. Sachs to begin a bookburning of books that
had opinions critical of Cornwell,
or else face legal action that would require the destruction of his
books,
in particular copies of Dr. Sachs’ novel The Virginia Ghost Murders.
The
letter used the actual words “destroy” and “books”, referring to Dr.
Sachs’
book, The Virginia Ghost Murders. This letter is deeply offensive to
writers
and intellectuals and to all those who oppose fascism and Nazis, to all
those who remember the victims of Adolf Hitler’s bookburning Nazi
Holocaust.
28. The Patricia Cornwell - Michael Rudell extortion letter, was also
designed to generate a strong and forthright response from Dr. Sachs,
and begin the process of controversy and lawsuit in which Rudell could
enrich himself from Cornwell’s ample money supply. Dr. Sachs’ response
to these ugly nazi threats was sharp, prompt and immediate. Dr. Sachs
faxed and mailed letters to the Cornwell gangsters telling Cornwell and
her gang to “take your threats and shove them up your criminal nazi
bookburning
ass”. In order to protect himself, and bring public shame on the
Cornwell
gang, Dr. Sachs began nationwide publicity of Cornwell’s neo-nazi
threats,
posting material on a website, sending faxes and press releases, and
putting
a sticker on the front of the published copies of his novel with
direct,
accurate, fully factual quotation of the Cornwell – Rudell extortion
letter.
29. The Michael Rudell 1 February 2000 extortion letter is an extremely
important letter for the entire case, and for the criminal indictments
against the Cornwell gang and the impeachment of Judge Payne. The court
record shows Judge Payne telling blatant falsehoods, despite the copy
of
this extortion letter right under his nose, Judge Payne speaking
falsely to the whole world and claiming that Cornwell never talked
about destroying books, despite the fact that “destroy” and “books” are
the actual words
used in the Rudell – Cornwell extortion letter, and the lawsuit filing
itself
demands the destruction of Dr. Sachs’ books! Cornwell committed direct
felony
perjury about this letter on the federal court witness stand, her own
lawyers
encouraging her to commit perjury in Judge Payne’s courtroom because
Judge
Payne was “working a deal” for her, and Cornwell’s perjury was part of
the
plan. On May 8, 2003, Judge Payne’s criminal thug Roberts also
committed
felony perjury about this key letter, claiming in a courtroom that he
never
saw the letter, though obviously instantly recognizing it, and despite
the
letter’s prominent presence in court records, court files, and Robert’s
own
files, in a case where Roberts fraudulently claims to assess a $100,000
legal
bill against Dr. Sachs for alleged “representation”.
30. When Judge Payne formalized his court order banning Dr. Sachs’
freedom of speech for the rest of his life, and issued his order that
Dr. Sachs must deface his own books or else be jailed, Judge Payne
repeatedly lied about the Rudell-Cornwell extortion letter, and ordered
the banning of perfectly true and accurate journalism and quotation
about this letter. Judge Payne ordering a neo-nazi banning of speech to
cover up for the neo-nazi actions of Patricia Cornwell and her lawyer
Rudell. Judge Payne himself began defacing one of Dr. Sachs’ novels in
the courtroom, the Judge’s
own fingers scratching and removing the journalistic sticker that
correctly
quoted the contents of the Rudell-Cornwell extortion letter.
31. Judge Payne was quoted as being “really pissed off” by Dr. Sachs
telling off Cornwell’s lawyers and telling them to shove it up their
behinds, Judge Payne speaking of Dr. Sachs that, “We need to show this
godd-mn little f-cker how The Game is played.” Judge Payne certainly
and
definitely did show, how "The Game" is played in a USA federal
courtroom. However, it is now time that this “game” of which Judge
Payne is so cluckingly proud, instead of just being known for the
private amusement of America’s lawyers and judges, it is now time that
Judge Payne’s “game” of bribery, fraud and treason, be put on display
for the entire world. It is now time the whole world knows “how The
Game is played” in the courts of the USA.
32. As Dr. Sachs began to publicize the nazi-style threats by Cornwell
and her lawyers, it became very clear that Dr. Sachs had the thorough
support of the American people. Though Dr. Sachs did not get any media
attention from his opposition to the Cornwell gangsters, he did get
very strong support from the American public on the internet and from
bookstores and readers. The American people don’t like Nazis and
crooked lawyers. They
don’t like threats and intimidation by the wealthy and powerful. They
don’t
like attempts to crush and silence opinion, and the burning and
defacing of books.
33. Cornwell’s lawyers were initially not successful in trying to
persuade Cornwell to give them several hundred thousand dollars to go
ahead and file a lawsuit against Dr. Sachs. The wealthy and powerful
Patricia Cornwell saw herself as far above an insignificant fellow
author like Dr. Sachs, and Cornwell’s initial impulse was to ignore Dr.
Sachs as
essentially irrelevant to her grand multi-million dollar career. One
more critic,
she told her lawyers, did not matter, given all the other people who
had
criticized her. Patricia Cornwell might have been right, but her
lawyers
then hatched some new plans to deceive and manipulate the half-crazy
and
half-stupid Patricia Cornwell.
V. False Article Planted
by
Republican Richmond Times-Dispatch
Newspaper to Assist Cornwell's Lawyers
34. Cornwell’s lawyers then conceived a clever plan to enrich
themselves out of Cornwell’s ample funds. Cornwell’s lawyers and
handlers were used to working with each other behind Cornwell’s back,
as Cornwell herself lives in a drug-induced fog and doesn’t like to be
bothered with details. They hatched the plan to plant a phony “news
story” in the right-wing Republican Richmond Times-Dispatch newspaper,
the flagship newspaper of the giant billion dollar Media General news
corporation. This paper has strong political ties to the same
politicians Patricia Cornwell is funding, like Governor Jim Gilmore who
has been living in Patricia Cornwell’s house and sleeping in her
bedroom. Moreover, the Times-Dispatch had a dishonest reporter, Bill
McKelway, who was eager to curry favor with Cornwell and would be glad
to plant a phony “news” story along lines dictated by the Cornwell
lawyers.
The lawyers’ initial contact to McKelway was via Cornwell stooge
Michael
McKee, an employee of “Patricia Cornwell Enterprises” who was also used
to working behind the back of the weird Cornwell.
35. This conspiracy by Cornwell’s lawyers Rudell, Gigante, and
Shumadine, proven in writing by mutual faxes visible in the case files,
was a clever plan on several accounts:
(a) Once the false “news” story was published, the lawyers waved the
phony “news” article at their stupid client Cornwell, and she gave them
a blank check for however many hundreds of thousands of dollars they
wanted for legal fees and bribes to crush and destroy Dr. Sachs and ban
his freedom of speech.
(b) The Times-Dispatch reporter McKelway – who never met Dr. Sachs and
never interviewed him -- followed exact instructions from
Cornwell’s lawyers in writing the phony front-page news story, so as to
serve as false evidence in federal court and provide an alleged basis
for immediate ban on Dr. Sachs freedom of speech.
(c) Penguin Putnam executives loved the idea that they were deceiving
the stupid Patricia Cornwell to spend hundreds of thousands of dollars
of her own money to file a neo-nazi lawsuit against Dr. Sachs, and pay
the bribes to get his freedom of speech banned, thus “protecting” the
tens
of millions of dollars in Penguin Putnam sales from Patricia Cornwell’s
books
(d) The false story about Dr. Sachs was written not only to set
up the lawsuit, but also to smear and slander Dr. Sachs and trivialize
and misrepresent his complaints about Patricia Cornwell. The lawyers’
goal was to insert the phony Times-Dispatch story into the national
news
media as a propaganda napalm-strike against Dr. Sachs, not only to
serve
as false evidence, but also to make it very difficult for Dr. Sachs to
get a lawyer or arouse further media interest, given the way that Dr.
Sachs’ opinions and actions were misrepresented.
(e) The gigantic Times-Dispatch Media General news corporation quickly
realized their reporter Bill McKelway had planted a false front page
news story to help the Cornwell lawyers. But as Cornwell’s lawyers
fully expected, the Media General Corporation felt that their best
course of action would be to join the conspiracy with a cover up, to
minimize their own liability and to help deceive the public about their
horrifying actions. So they
printed more false stories about the case, hiding their own role in
planting
false evidence, they supported imposing a lifelong ban on Dr. Sachs’
freedom
of speech and provided important backing for the threats to have Dr.
Sachs illegally jailed and murdered.
36. The basic thrust of the phony news story fabricated in the
Times-Dispatch newspaper at the request of Cornwell’s lawyers, was to
fabricate a phony “interview” with Dr. Sachs, in which Dr. Sachs was
allegedly publicly claiming that Patricia Cornwell was still copying
Dr. Sachs’ novel, even though
she had already suspended the publication of her new book and
re-written it to eliminate much of the copying. The article was false
on several fronts. There was no interview with Dr. Sachs - the reporter
McKelway never even met him! - and quotations from him were fabricated
and manufactured, and Dr. Sachs was making no public claims of copying
by Cornwell, given the
signals she was changing her manuscript around – what Dr. Sachs was
criticizing
about Cornwell was her neo-nazi extortion letter demanding his silence
and
threatening to destroy his books. The purpose of the fraudulent article
in the right-wing Republican Times-Dispatch newspaper, was to shift the
focus of attention away from Cornwell’s neo-nazi book-destroying
threats,
onto alleged claims of plagiarism regarding a book that Cornwell had
already
re-written. This phony “news article” would then serve for Judge Payne
and
the Cornwell gangsters, as a fraudulent basis of evidence for banning
Dr.
Sachs’ freedom of speech for the rest of his life, and would serve to
help
the Cornwell criminals deceive the entire national news media as to
what
the controversy was really about. Judge Payne and the Cornwell
criminals
then argued a legal case based on fraudulent “evidence” that the
Cornwell
lawyers themselves had manufactured.
37. Within hours of the phony “news story” by the dishonest reporter
Bill McKelway being published in March of 2000, Dr. Sachs denounced the
story, began trying to interrogate the Times-Dispatch officials, and
began searching for a lawyer to sue the Times-Dispatch for libel, only
to find that Virginia lawyers are extremely afraid of the power of this
newspaper in what was obviously a political scheme with Cornwell. The
highest Media General Times Dispatch executives immediately went into
cover-up mode,
violating all journalistic ethics by refusing to print Dr. Sachs’
letter
to the editor. The Times-Dispatch didn’t try to deny they had planted
the story to serve as false evidence in an upcoming lawsuit, and didn’t
try to deny they had written the false story in fulfillment of
instructions
from Cornwell’s lawyers. Dr. Sachs notified Cornwell’s lawyers in
writing,
of the clearly false nature of the story, but Cornwell’s lawyers had an
open checkbook from Cornwell, so it was full speed ahead with knowingly
filing false evidence in federal court, and a scheme of treason against
the
US Constitution. Ample legal files, easily viewed in the case files or
at the files of the Times-Dispatch and their Richmond, Virginia
Christian
& Barton law firm, quite prove the criminal guilt of the
Times-Dispatch
and Media General Corporation, in fabricating false evidence in a US
federal
court case.
VI. Judge Payne and his
Thug
Roberts
38. Without any advance warning, and without any direct communication
to Dr. Sachs since they faxed and mailed him the 1 February, 2000
extortion letter, the Patricia Cornwell lawyers filed their neo-nazi
lawsuit against Dr. Sachs in April of 2000, with the phony
Times-Dispatch “news story” they had planted and fabricated, as the
prime piece of “evidence” against Dr. Sachs.
39. The lawsuit presented a new fascist theory of how to ban a
journalist’s and writer’s freedom of speech. Using the United States
“Lanham Act” or trademark law, noting that Patricia Cornwell was a
famous person, and Dr. Sachs was a writer with books for sale, the
lawsuit said that all of Dr. Sachs’ writing, journalism, speech and
opinions could be evaluated by
a federal judge as to whether he had “false opinions used for
marketing” of Dr. Sachs' books, his “product”. The lawsuit said that a
writer and journalist like Dr. Sachs was just a commercial provider of
a “product”, and thus that if a federal judge did not perfectly agree
with Dr. Sachs’ opinions and journalism, he could completely ban all of
Dr. Sachs’ freedom of speech as “false advertising for his product” –
his writing and books – because all opinions about
Patricia Cornwell were a violation of the Patricia Cornwell “trademark”
if the federal judge did not perfectly agree with Dr. Sachs’ opinions.
And the Virginia federal judge taking the case was right-wing US
Federal
Judge Robert Payne, who is quoted as admiring Adolf Hitler, and whose
personal
opinions happen to agree with right-wing neo-nazi Patricia Cornwell and
her sleazy neo-nazi lawyers who threatened to destroy Dr. Sachs’ books.
40. Right wing Judge Robert Payne is a federal judge held in great
scorn by Virginia’s lawyers, who laugh at him behind his back, as a
“crooked and stupid redneck judge”, an “assh-le who likes to terrorize
people”, a “Neanderthal lowlife who has no business being on the
federal bench”. Another lawyer says, “This Judge Payne who f-cked you
over by hooking you up with this piece of sh-t Roberts, he’s a strange
one. He’s got some mental problem, like his dick is too short or
something. He puts on those black robes
and sits on that judge’s bench, and he thinks he’s God or Adolf Hitler
or
somebody. Total f-ckin’ jerk.” “Lawyers are all afraid of him. I don’t
think
anyone will have the guts to help you fight him. But sure, Judge Payne
would
be glad to jail you and see you get your throat cut, no doubt about
it.”
Even Judge Payne’s own thug Roberts describes Payne as “A totally
ruthless assh-le with no ethics or scruples at all.” The word most
frequently used by lawyers to describe Judge Payne is “assh-le”, but
lawyers frequently also talk about Judge Payne’s “stupidity”,
describing him as, “One of those judges who thinks he’s smart, even
though he’s a f-ckin’ dumbsh-t.” Another lawyer said that Judge Payne
“is jealous of people who he knows are smarter than he is, that’s part
of why he really wanted to f-ck a guy like you over on this case. He
wanted to show he’s the big f-ckin’ boss, shut you up for the
rest of your life.” “Payne don’t give a f-ckin’ godd-mn about the
Constitution.” As Dr. Sachs contacted thousands of Virginia lawyers in
the attempt to find someone to fight the Patricia Cornwell – Judge
Payne scheme of fraud and treason, he got quite an earful about Judge
Payne by the many lawyers who revile him behind his back, but are too
afraid to confront Judge Payne to his face as they “play the game” of
the USA’s crooked legal system.
41. The Patricia Cornwell lawsuit asked for a neo-nazi style ban on Dr.
Sachs’ freedom of speech, and the bookburning destruction of any books
that Dr. Sachs published with critical opinions of Patricia Cornwell.
42. Within a matter of mere minutes after the lawsuit was filed, Judge
Payne, having already had things worked out with Cornwell’s lawyer that
Judge Payne fondly calls “our boy Shumadine”, Judge Payne immediately
imposed a ban on Dr. Sachs’ freedom of speech, prohibiting all media
contact, Dr. Sachs being without a lawyer, without trial, without
hearing, and without time to even read the legal papers. Dr. Sachs was
served with a thick
wad of legal papers one afternoon at about 3pm, by a grinning, smirking
process server, and at 5pm Dr. Sachs was tossed into a conference call
with
Judge Payne and Cornwell’s lawyer Shumadine, a conference call in which
Dr. Sachs was ordered by Judge Payne to be silent about the neo-nazi
lawsuit
filed against him. As the transcript shows, Cornwell’s lawyer Shumadine
began spinning an elaborate fabric of lies based on the false evidence
that
Shumadine himself had conspired to plant in the Times-Dispatch
newspaper.
Cornwell’s lawyers argued that the phony newspaper article was the
basis
for an immediate ban on Dr. Sachs' freedom. Dr. Sachs informed Judge
Payne
that the article was phony, but Judge Payne banned Dr. Sachs’ freedom
of
speech and any public reply to the article. Judge Payne wanted to
prevent Dr. Sachs from finding a real lawyer to help him, and Judge
Payne
wanted
to help the Times-Dispatch deceive the American public about Cornwell,
with Dr. Sachs banned from replying to the Cornwell gang propaganda and
to
the
phony news stories that would be coming from the Richmond, Virginia
right
wing newspaper. So within minutes after the lawsuit was filed, Judge
Payne
began taking unlimited tyrannical control over Dr. Sachs’ life, freedom
and opinions, while leaving the right wing newspaper associated with
Cornwell, free to continue its propaganda against him.
43. Judge Payne adopted a mock patience with Dr. Sachs’ searching for a
lawyer, whereas Judge Payne and the Cornwell gangsters knew perfectly
well that Dr. Sachs would not find a lawyer, with no money and with his
speech already banned and without access to the news media to tell his
side of the story, while Judge Payne allowed the Times-Dispatch to
freely spread their right-wing propaganda for the Cornwell gang, and
discourage and deceive lawyers from representing Dr. Sachs.
44. A few days later, however, Judge Payne did start selling to Dr.
Sachs the services of an alleged “lawyer” who would “fight” for Dr.
Sachs’ First Amendment rights, this “lawyer” being none other than the
notorious gangster and fraud Thomas Roberts. Roberts is recognized by
his colleagues as “the biggest piece of sh-t crooked con artist phony
lawyer in the entire state of Virginia”. Attorneys view Judge Payne’s
thug Roberts as Virginia’s most crooked lawyer because of the
fraudulent
way that Roberts represents himself as a “civil rights lawyer” even
though
he is a fraudulent criminal tool of Virginia’s “good ol’ boy” crooked
Southern establishment; and because of how he and Judge Payne developed
and evolved the blatant fraud, in writing, that Roberts was part of a
“First Amendment charity civil rights Foundation”, the so-called
“Freedom
Works Foundation”, which felony fraud they were so brazen and bold as
to
put in writing, and serve today as grounds for the immediate arrest of
Roberts,
and the impeachment of Judge Payne!
45. Judge Payne and his thug Roberts both entered onto the hard
sell to Dr. Sachs of Roberts’ services and his bogus non-existent
“First
Amendment charity Foundation”. Roberts claimed that this “First
Amendment
charity Foundation” involved First Amendment lawyers “around the
country”,
including Professor Rodney Smolla of the University of Richmond, and
that
at a certain point in the case, this “Foundation” would be paying some
of Dr. Sachs’ legal fees after initial investment by Sachs with
Roberts.
Roberts promised a “great First Amendment battle” for Sachs, that he
would
“kick Cornwell's teeth in” with countersuits and motions and aggressive
litigation, that Dr. Sachs would “never” have any ban on his freedom of
speech permanently imposed on him, and that Roberts would “never”
abandon Dr. Sachs regardless of his financial situation. Judge Payne’s
thug
Roberts
was so emboldened about being joined in a criminal scheme with Judge
Payne
himself, that he put the fraud about the “First Amendment charity
foundation”
and its “assistance” to Sachs in writing in the contract he directed
Sachs to sign or else not have a lawyer. This fraudulent document may
be viewed by the entire world on file at the city of Richmond
courthouse,
where Roberts himself has boldly placed evidence of his own felony
crimes,
as Roberts later tried to extort money out of Dr. Sachs.
46. This felony fraud of the bogus “Civil rights charity foundation”
continues to go on even today – As of March 2004, Judge Payne’s pet
thug Roberts, emboldened by continuing in a felony scheme together with
Federal Judge Payne, still touts and advertises his non-existent
fraudulent charity Foundation on his website. On one page of the
website, Roberts calls himself the “spokesman” for this non-existent
foundation. On another page, Roberts calls himself an “affiliated
attorney” with this non-existent foundation. Judge Payne’s thug Roberts
is so casual about his fraud, he’s even willing to play the fraud in
several ways on the same website. Judge Payne banned Dr. Sachs’ freedom
of speech for the rest of his life, with Judge Payne’s laughable claim
that Dr. Sachs’ journalism was misusing Patricia Cornwell’s name for
“marketing”. It is clear that in this whole criminal scheme of
the Patricia Cornwell gang of criminals, the most interesting
“marketing”
is Judge Payne’s marketing of the criminal thug Thomas Roberts and
their
bogus and fraudulent "First Amendment charity foundation".
47. As the Special Prosecutor, the FBI, the Appeals Court, and the
entire world’s journalists can verify with just a few minutes worth of
phone calls to state and federal charity and foundation regulators,
this “Freedom Works Foundation” that Judge Payne and his thug Roberts
are selling, is a fabrication and fraud, and Judge Payne and Roberts
are guilty of
multiple felony counts for committing this fraud for commercial
purposes,
and for bribery and for treason against the Constitution. Of course,
Judge
Payne has thrown a blanket of protection over this felony fraud, by
ordering
that Dr. Sachs be jailed if he speaks of this felony fraud to the media
or the American people.
48. On 8 May 2003, in a city of Richmond courtroom, Judge Payne’s thug
Roberts both acknowledged that his “Freedom Works Foundation” was in
fact a non-existent, fraudulent entity, never registered, with no
funds, and not involving anyone other than himself and Judge Payne.
Roberts made clear that Judge Payne was in on the deal with him when
the fraudulent “foundation” was being represented and sold to Dr.
Sachs, and Roberts boasts of protection of Judge Payne and the US
George Bush government in this scheme, as all these counts of criminal
fraud are in the service of Bush campaign contributor Patricia Cornwell.
VII. It’s Time for the
Immediate
Arrest of Judge Payne’s Thug Roberts
49. As American lawyers agree, this felony fraud of Judge Payne
and his thug Roberts, with their fraudulent “First Amendment charity
foundation” that they used to commit treason against the United States
Constitution, is by itself grounds for the instant arrest and
indictment
of Judge Payne’s thug Roberts, and instant grounds for the impeachment
of Judge Payne himself.
50. This felony fraud by Judge Payne and his thug Roberts is so
crystal clear, so well evidenced, so blatant, that even the dumbest,
stupidest, biggest idiot and moron of a prosecutor in the George Bush
Justice Department, can issue a felony indictment against Judge Payne’s
thug in the next fifteen minutes. No multi-million dollar investigation
is needed, as the FBI already has the crystal clear evidence in their
hands. And if the FBI and US Attorney have “misplaced” or shuffled away
the evidence, sweeping these felony crimes relating to a Bush campaign
contributor under the rug, out of worry that Bush Attorney General
Ashcroft
“won’t like it”, no problem, they can easily pick up a fresh copy at
the
city of Richmond courthouse on the way to arrest Roberts.
51. It is an utterly shocking disgrace to the USA, its legal system and
its lawyers, that Judge Payne’s thug Roberts is still walking the
streets of downtown Richmond, Virginia, without being yet scooped up by
the FBI, despite clear written evidence of Roberts’ guilt in felony
federal fraud, acts of terror, and treason against the Constitution. Of
course
the problem here is political – that these felonies were in support of
George Bush election campaigns and Republican campaign contributor
Patricia Cornwell. But the time has come. It is about a fifteen minute
drive from the Parham Road FBI office to Thomas Roberts’ office at 105
South First
Street in downtown Richmond. (Note to FBI: Bring a van, there are
several
file boxes to take back to the Special Prosecutor.) Roberts will not be
surprised as to why the FBI is reading him his rights. As the great
writer
Dostoevsky pointed out, there is in all major criminals a secret
craving
to be caught and punished.
52. Although Judge Payne’s thug has been in a criminal scheme of fraud,
extortion and treason with the full backing of Judge Payne and,
apparently, the United States government, he is really just a small
time criminal hood and turd, who will sing like a canary to the Special
Prosecutor with a very slight bit of pressure, rather than spend the
entire rest of his life in prison. Thoughtful plea-bargaining by the
Special Prosecutor with Judge Payne’s thug Roberts, can be the
initiating source of many, many more felony indictments, such as at
Cornwell’s Willcox & Savage law firm, and the revelation of the
fullest details of this sordid scheme of treason.
53. Roberts had a law partner at the time of the original Judge
Payne – Patricia Cornwell extortion scheme, the German-born Tim
Schulte,
who left today’s modern, ethical Germany, to come and make the “big
money”
in the USA environment of legal corruption. Schulte is also a fully
guilty
participant in extortion, felony fraud and treason. After the Cornwell
extortion and treason was executed, Schulte later left the Roberts law
firm,
as he realized that Dr. Sachs was not going to let this extortion and
treason
lie unopposed. If Schulte is still within the borders of the USA, he
will
very likely quickly flee the USA when the scandal breaks open, much as
Patricia Cornwell herself likely will, so the FBI should act quickly if
it wants to get Schulte and Cornwell while they’re still inside USA
borders.
VIII. Judge Payne Stages
the
Fraudulent Court Proceeding
54. The Judge Payne – Patricia Cornwell phony “show trial”, was
a fraudulent court proceeding designed by Judge Payne to present the
fraud that Dr. Sachs had a lawyer “representing” him, and the fraud
that
somehow Dr. Sachs “agreed” to the permanent ban on his own freedom of
speech for the rest of his life. It was a matter of some weeks before
Dr. Sachs realized that the lawyer Roberts was actually a criminal thug
planted in the case by Judge Payne and the Cornwell gangsters, but by
then Dr. Sachs was sealed inside Judge Payne’s trap of extortion,
warned
that
any attempt to prevent Roberts from continuing to pose as his lawyer,
would
result in his own jailing and likely death.
55. Roberts had several functions in the fraudulent role as Dr.
Sachs’ alleged “lawyer”. The main one of course was to be the hatchet
man of the Patricia Cornwell – Judge Payne extortion scheme, and at the
moment desired by Judge Payne, to make the threats of illegal jailing
and murder to fulfill the conclusion of the fraudulent court
proceeding.
But also very important, was Roberts’ role in producing a falsified
court
record and an utterly misleading case file, with the key facts of the
case
never presented, the key elements of fraud and perjury never questioned
or cross-examined, and to make sure that no counter-suits were filed
against
the half-crazy Patricia Cornwell. Roberts carried out his criminal
mission
by weaving a constant web of lies, deception and fraud of Dr. Sachs, in
connection with his fraudulent claim to be working with “First
Amendment
lawyers around the country” who were involved with the non-existent
“First
Amendment charity foundation”. The chief tactic Roberts used was to
inform Dr. Sachs that he was in a legal case that would last several
years,
and
that most of the key issues would be raised at a significant stage “a
number
of months later”, based on the “expert judgment” of First Amendment
lawyers
“around the country”. Actually, of course, Judge Payne’s thug Roberts
was
carrying out the mission of hiding the essential facts from the court
record,
and serving the Patricia Cornwell – Judge Payne conspiracy of treason.
Judge
Payne’s deal with Roberts is that Roberts would be paid solidly out of
bribery
funds channeled through Cornwell’s Willcox & Savage law firm, plus
what additional funds that Roberts could defraud out of Dr. Sachs
himself.
56. In the early days of the case, Roberts made a partial show of being
a lawyer who would actually be an aggressive defender of Dr. Sachs. He
assembled a pile of articles and legal citations showing that Patricia
Cornwell was much more well documented as a criminal piece of scum than
even Dr. Sachs imagined. He took a deposition of Cornwell – on
videotape as well as on transcript – in which the stoned and half-crazy
Cornwell
made a babbling fool of herself, and showed herself to be the kind of
self-destructive witness that any decent lawyer could cut to pieces.
Cornwell stated she
was induced to spend the hundreds of thousands of dollars to sue Dr.
Sachs
because of the Times-Dispatch article, unaware that her own lawyers had
planted
this article. Roberts didn’t reveal the truth to Cornwell, telling Dr.
Sachs
that she would be confronted with this “later”. Cornwell also shrieked
hysterically when confronted with the idea she would be counter-sued.
It seems the lawsuit would be over within a few days, in Dr. Sachs’
favor.
57. However, not long after the Cornwell deposition, Roberts said that
after “technical analysis” by “First Amendment lawyers around the
country”, it was “impossible” to file any countersuits against the
Cornwell people, but instead there would be a “claim for sanctions”
against Cornwell at a stage of the case “some months later”. At the
time, Dr. Sachs was
still being taken in by the lies of Roberts and his bogus “First
Amendment
charity foundation”.
58. Roberts produced a couple of brief legal filings in preparation for
the May, 2000 hearing on formalizing Judge Payne’s ban on Dr. Sachs’
freedom of speech. Dr. Sachs immediately protested to Roberts that
these filings left out the key facts of the case, and of the
controversy with Cornwell. Judge Payne’s thug Roberts overruled Dr.
Sachs with more lies
about how the “narrow approach” of Roberts’ filings were those
advocated
by “the best First Amendment legal minds in the country, like Professor
Rodney Smolla”, and that Dr. Sachs needed to go along with this “legal
expertise”
if he wanted to have a lawyer at all. It turned out these two short
legal
filings, would be the only significant legal filings Roberts made in
his
fraudulent “representation” of Sachs for which Roberts claims Dr. Sachs
owes some $100,000 plus 18 percent interest to Roberts.
59. In May of 2000 there was a one day hearing in which Judge Payne
formalized the ban on Dr. Sachs’ freedom of speech for the rest of
life, despite Dr. Sachs eloquent, Jeffersonian statement that “my book
is my newspaper”, a clear instrument for communication of newsworthy
opinion
with the American public. Judge Payne’s hearing was a bizarre, brutal,
fascist experience, like one imagines in a court of Hitler’s Nazi Reich
or Joseph Stalin’s Russia. Judge Payne laughed and joked with
Cornwell’s
lawyers, most especially the lawyer he fondly calls “our boy
Shumadine”,
and made friendly eye contact with Shumadine throughout the episode.
Most
notably, Judge Payne grinned and smirked with Shumadine when Judge
Payne
spouted the laughable statement that the lifelong ban on Dr. Sachs’
freedom
of speech was a “narrow” restriction on his freedom. With Dr. Sachs,
Judge
Payne screamed at him, twisted his words around, desperate to cut his
words
off, and shouted angry falsehoods in favor of Patricia Cornwell, Judge
Payne
claiming there was "no scandal” involving Cornwell, and Judge Payne
blatantly
lying about the Cornwell extortion letter threatening to destroy Dr.
Sachs’
books. Patricia Cornwell committed felony perjury on this issue in the
courtroom, but Judge Payne’s thug Roberts refused to cross-examine her
and expose her perjury, explaining to Dr. Sachs that this would “make
the
judge angry” and the Judge might jail Dr. Sachs on the spot if Roberts
was “too hard” on Cornwell.
60. Judge Payne imposed a total lifelong ban on Dr. Sachs saying
anything at all about Cornwell on all forms of media communication
which Dr. Sachs then owned, on or in his book or on the internet, along
with a vague clause that any additional “marketing” by Dr. Sachs using
Cornwell’s name was prohibited, which Judge Payne made clear meant that
Dr. Sachs must be totally silent about Cornwell or anything to do with
the legal proceeding
against him. Dr. Sachs was banned from talking about how his speech was
being banned, and getting the sympathy and support of the American
people,
because Judge Payne and the Cornwell thugs claimed this would be Dr.
Sachs
“taking advantage of his speech being banned.” Very shockingly, Judge
Payne
ordered the defacing of Dr. Sachs’ books, with Judge Payne himself
personally
defacing one of Dr. Sachs’ books in the courtroom, and Judge Payne
ordered Dr. Sachs to send around letters to bookstores and distributors
that
destroyed Dr. Sachs’ publishing business, by informing them that he was
in legal
trouble. Judge stated his intention to conduct a “speedy” conclusion to
banning Dr. Sachs’ freedom of speech, meaning of course a speedy
extortion,
a speedy suppression of the truth, and a speedy political deception of
the American people.
61. As quoted by his own thugs, the pro-Hitler Judge Payne deeply
resented Dr. Sachs for his remembering the victims of Adolf Hitler’s
Nazi Holocaust, Judge Payne declaring, “That godd-mn Hitler was right.
I’m sick and tired of these godd-mn f-cking Jews,” Judge Payne perhaps
taking Dr. Sachs for a Jewish intellectual because of his name. Judge
Payne
labeled Dr. Sachs as “an overeducated smart ass who needs to have his
f-cking
mouth shut for good”, and observed of Dr. Sachs that, “This little
f-cker
could do some damage to the political cash flow unless we shut his damn
mouth.”
62. After the hearing, Judge Payne’s thug Roberts began to terrify Dr.
Sachs with lurid tales of how obviously eager Judge Payne was to jail
Dr. Sachs. Judge Payne’s courtroom bullying was explained as an attempt
to induce the slightest signs of lack of submission to Judge Payne, for
which Judge Payne could immediately impose a bogus contempt-of-court
jailing. Roberts, who knew that Dr. Sachs had been raped by his
stepfather as a
child, used this knowledge to discuss how Dr. Sachs would be raped
repeatedly
in a prison cell after Judge Payne sent him there. Roberts also spoke
of
how Patricia Cornwell, with her obvious criminal connections in
Virginia
government and law enforcement, and her connections to criminals
through
the illegal drugs she obviously used, would easily hire people to “do
things,
horrible things” to Dr. Sachs when he was in jail.
63. Roberts pointed out the lurid truth about the American prison
system, the world’s most notorious gulag with 2 million prisoners, 25
percent of the prison population in the entire world, many of them
innocent,
and even many innocent people on death row and being executed, in
addition to all those who are mysteriously murdered in jail cells,
found hanged or
stabbed in a cell with no one admitting to know anything about it.
Roberts told Dr. Sachs that “no one is gonna care about one more
prisoner”, and
that he might be restricted in how helpful he could be if Dr. Sachs was
jailed, given that he himself would face revenge and contempt of court
from Judge Payne if he talked too loudly about it.
64. Roberts especially drew a parallel between the prospective jailing
of Dr. Sachs, and the earlier bogus contempt-of-court jailing of
Richmond black political leader Chuck Richardson. The jailing of the
outspoken Richardson was generally understood as a completely racist
and fraudulent political jailing by Virginia’s white establishment, and
associates of white
Republican governor Jim Gilmore also declared that the trumped up
Richardson
jailing was an attempt to “get rid of some of these loudmouthed blacks
and give Richmond back to the white people”. Judge Payne also scorned
Dr.
Sachs as someone “as bad as a loudmouth Negro”; though Dr. Sachs would
certainly
be honored to be in the tradition of the great black political leader
Dr.
Martin Luther King, Jr.
65. Roberts also informed Dr. Sachs that in the current status of the
case, and the difficulty of the many court levels it would take to
overturn Judge Payne’s order, the crooked Judge Payne would likely
engineer a civil judgment against Dr. Sachs that could never be voided
by bankruptcy. Roberts misrepresented the debtor laws, and told Dr.
Sachs that most
all of any earnings would be taken from him so he could never live
anywhere except a homeless shelter, regardless of income, and Dr.
Sachs’ elderly
beloved cat would be taken from him and put to death.
66. Judge Payne papered over his illegal ban on Dr. Sachs’ journalism
and freedom, with a nonsensical 50 page order, that Judge Payne
obviously had written before the hearing with his clear intention to
ban Dr. Sachs’ freedom of speech regardless of what was said in court.
Judge Payne’s
50 page court order banning Dr. Sachs’ speech, is a junkpile of lies,
smoke and nonsense, covering up for key facts, Judge Payne making false
statements for the Cornwell group, and boiling down to Judge Payne
hating Dr. Sachs’ opinions and so executing a fascist ban on Dr. Sachs’
freedom
for the rest of his life. Judge Payne pretended that Dr. Sachs’ satiric
teasing of Cornwell, in saying that her sleazy activities would make
“great
marketing” for his own book, Judge Payne took this comment as Dr.
Sachs’
waiving his freedom of speech for the rest of his life, Judge Payne
pretending
that Dr. Sachs’ teasing was some sort of advance prediction that there
was nothing but “marketing” in Dr. Sachs’ anti-nazi and anti-fascist
opinions,
and in his journalism about the Cornwell gangsters.
67. After the hearing, Dr. Sachs totally shut down his publishing
company and stopped selling books, partly because of Roberts’ warning
that continuing to write and publish would increase the chance of Dr.
Sachs’ jailing by Judge Payne, and also to make the point that it was
obviously false that Dr. Sachs’ complaints about Cornwell had anything
to do with crass “marketing” of his mystery novel. For Judge Payne and
the Cornwell gangsters, however, the story that they were banning Dr.
Sachs’ freedom of speech because of trademark law and concerns about
“marketing”, was
just a fictional cover story, for what was really a fascist political
extortion and suppression of an American writer to benefit the
right-wing political campaign contributor Cornwell.
68. With Dr. Sachs driven to the edge of despair by Roberts’ various
assertions about Dr. Sachs being sent to a homeless shelter, watching
while his cat was put to death, and illegally jailed and raped in jail,
Roberts began to moderate his approach to somewhat less of a degree of
terror,
and then talked about an appeal he had filed that would put off things
“for many, many months” while Roberts continued to work with “First
Amendment
lawyers around the country”. Roberts put Dr. Sachs to work
sending
around a fundraising letter which Roberts said had Judge Payne’s
approval,
asking organizations around the country to send money to the Roberts
law
firm for Dr. Sachs’ defense. Roberts said that was a necessary step
before getting financial assistance from the people involved with
Roberts’ non-existent “Freedom Works Foundation”.
69. Dr. Sachs has never been allowed to have his own personal legal
files, which have remained in the possession of Roberts and the
Cornwell criminals ever since Judge Payne’s phony fraudulent court
proceeding.
In 2002 Dr. Sachs did, however, have a chance to review these files
briefly for a few hours after finding them in a Kinko’s Copies store,
where Dr. Sachs spotted the file boxes with his name on them and a
Kinko’s employee let Dr. Sachs see them. Dr. Sachs was forced to give
his own files back
to Roberts under threat of jail. When the Special Prosecutor and FBI
finally seize the legal files in Thomas Roberts’ possession, they will
have further proof of what a criminal fraud Thomas Roberts was in the
Cornwell case.
There is virtually no legal work at all in the file; the several boxes
that
Roberts represents as “look at all that legal work” is mostly composed
of
things like the same magazine articles on Patricia Cornwell copied over
and over again. There is almost no legal work done by Roberts in the
case,
no preparations for trial, no working with “First Amendment lawyers
around
the country”; clearly, Judge Payne’s thug Roberts was just marking time
till
he executed the criminal extortion for Judge Payne and Patricia
Cornwell.
70. In the further weeks that remained in the fraudulent court
proceeding, before Judge Payne and his thug Roberts completed their
criminal extortion of Dr. Sachs, with Dr. Sachs assigned by Roberts to
the duty of sending out hundreds of fund-raising letters for the
Roberts law firm, a number of incidents happened which can serve as
basis for further felony indictments of Judge Payne’s thug. Some
publisher’s organizations offered to file amicus curiae briefs in
support of Dr. Sachs’ freedom, and Roberts claimed to
be “working closely” with these organizations, but actually Roberts
blew
them off. A real New York First Amendment lawyer, Dorothy M. Weber,
contacted Dr. Sachs and the Roberts firm with an offer of free legal
assistance and brief-writing, and Roberts claimed to be “working
closely” with her as
well, though Ms. Weber later witnessed that Roberts and his partner
Schulte “totally blew her off”.
71. In support of Patricia Cornwell’s perverted neo-nazi desires to
invade the privacy of American citizens, Cornwell lawyers demanded a
list of all American citizens who were known to have read and purchased
Dr. Sachs’ mystery novel, The Virginia Ghost Murders. Dr. Sachs did in
fact
have a list of book buyers, many of them private individuals, in the
logs
of his publishing company. Dr. Sachs found the Cornwell request deeply
offensive, just like in the case where Ken Starr tried to get a
bookstore to reveal what books Ms. Monica Lewinsky was reading. Dr.
Sachs directed Roberts
to make a strong stand on the Constitution’s right of privacy against
the
perverted neo-nazi Patricia Cornwell, and though Roberts said “all
sorts
of motions are being filed, it’s a great battle”, it seems that Roberts
did nothing to make a stand against Patricia Cornwell’s fascist
invasion of America’s private lives.
72. In addition to doing nothing to take advantage of lawyers and
organizations willing to help Dr. Sachs, Judge Payne’s thug Roberts was
doing absolutely nothing to prepare for trial, and nothing to pursue
the one sentence appeal form that had been filed at the Court of
Appeals
that was pretending to appeal Judge Payne’s illegal orders. Roberts was
still waiting for the right moment to spring the extortion threats to
jail and kill Dr. Sachs along with a fraudulent “settlement”. Roberts
didn’t
even mention anything about a quick trial date that was set for August,
until springing this news onto Dr. Sachs just right before the
extortion.
IX. Judge Payne’s Thugs
Carry
Out Extortion and Treason
73. Another aspect of the farcical Judge Payne court proceeding, was
the equally farcical “mediation negotiation” that was carried on as
a part of the case, involving “Judge William Howell” of South Carolina,
a “mediator” for trials in the Fourth Circuit. Judge Payne’s thug
Roberts laughed at Judge Howell, calling him a “stupid old fart”, and
indeed Judge Howell’s role in the case was quite shameful. There were a
few conference calls involving the Roberts firm, Judge Howell and the
Cornwell gangsters. Judge Howell’s idea of “mediation” was simply to
suggest that Dr. Sachs, who had no money at that time, be submissive to
the wealthy Cornwell and her lawyers. Judge Howell showed no interest
in the Constitution at all, and merely acted as a messenger boy for
Cornwell’s slimy lawyer Shumadine, and openly served as a conduit for
discussions of federal court bribery, Howell seemed glad to condone
bribery so long as it led to a “settlement” of a case.
74. It was in one of these conference calls with Judge Howell, that Dr.
Sachs realized that he had been completely defrauded and deceived
by Roberts and by Judge Payne, and that he was in the middle of an
extortion trap of bribery funded by Patricia Cornwell and in which
Judge Payne
himself was a major participant. The scheme was revealed by Roberts’
junior
law partner Tim Schulte, who was very excited and thrilled about being
involved in an actual USA federal bribery scheme, and started to brag
about the scheme to Dr. Sachs.
75. There was a conference call with Judge Howell, in which Schulte was
there with Dr. Sachs, though Roberts was not present. Howell relayed
the shocking demand from Cornwell’s lawyers, that Dr. Sachs agree to
having his speech permanently banned for the rest of his life, as a
“settlement” of the case. Dr. Sachs was horrified at the idea that
Judge Payne’s obscenely illegal and unconstitutional court order would
go unappealed. But, even
more horrifyingly, the lawyer Schulte, who was supposedly
“representing” Dr. Sachs along with Roberts, immediately launched into
a request for
how
much of a bribe Schulte and Roberts would get in exchange for carrying
out
this “settlement”. Schulte asked for $100,000, and pointed out that the
bribe could be put into writing, as Patricia Cornwell’s “payment of Dr.
Sachs’ legal fees”. Judge Howell said he would talk to Shumadine about
the
bribe request and get back to him. Nothing at all was said about Dr.
Sachs’
rights or the Constitution, and no one cared. Judge Howell appeared to
take
the bribery request as if it were business as usual.
76. Dr. Sachs was stunned, and speechless for several moments. The veil
fell from Dr. Sachs’ eyes, and he realized how Judge Payne, the Roberts
law firm, and the Cornwell lawyers were all in the same criminal
enterprise together, with Dr. Sachs and the Constitution as just pawns
in the brutal game of treason being played. When he found the strength
to speak, Dr.
Sachs asked Schulte, “You’re trading my Constitutional rights just for
a bribe from the Cornwell lawyers?” Schulte grinned. “We didn’t take
this
case because we gave a sh-t about your rights. We took this case to
make
money. We can’t get any money from you, so we have to get it from
Cornwell!”
Schulte’s grin grew wider and wider. And then he added, “And if you
think
you might want to fire us as your lawyers, just think of how long
before
Judge Payne will jail you if you fire us.” Dr. Sachs almost threw up on
the spot.
77. To Dr. Sachs, it was absolutely paramount, whatever the financial
damage to himself, that Judge Payne’s illegal order be appealed and
overturned. Even if the appeals court was dishonest enough to uphold
Judge Payne’s nazi-style order, Dr. Sachs was determined, of his own,
that the appeal be made. Dr. Sachs expressed his determination to
Roberts not to “settle” the case in any way that involved maintaining
Judge Payne’s illegal order, hoping that the Cornwell criminals would
perhaps pull back from the desire to commit treason against the
Constitution. But at the same time, Dr. Sachs realized that, as Schulte
warned, he was now caught in a trap set by Judge Payne,
that would result in his own jailing and murder if he wasn’t careful.
In
the legal files, you can see Dr. Sachs making fervent but hopeless
attempts to get Roberts to back away from the scheme of extortion and
treason, Dr. Sachs imploring Roberts to start acting like a genuine
lawyer and defend the Constitution, but it was to no avail.
78. A few days later, Dr. Sachs was called back to Roberts’ office.
Roberts began to set up the final extortion. Roberts told Dr. Sachs
that he was “lucky” to have the Roberts firm, or else he would be in
jail now. Dr. Sachs was told there would be a trial in just a few
weeks, a trial
without a jury, Judge Payne did not want any jury to interfere with his
banning of Dr. Sachs’ freedom of speech, “because a jury might like the
f-cker, and won’t do what we want here,” according to Judge Payne as
quoted
by Roberts. Roberts revealed a farce going on among the two sets of
Cornwell
lawyers, whereby Judge Payne was allegedly and privately reading “early
drafts” of Cornwell’s writing to see if there were any “similarities”
to Dr. Sachs’ book. Dr. Sachs pointed out this was obviously a pile of
nonsense
– these unseen documents would certainly not be genuine “early drafts”,
and Dr. Sachs had no interest in Judge Payne’s alleged “literary
opinions”,
given
how Judge Payne had made blatant false statements to protect Cornwell
on
the court record. Roberts informed Dr. Sachs that there would probably
be
a “settlement package” shortly. Dr. Sachs informed Roberts that there
should
be no settlement involving damage to the Constitution. Roberts said
“we’ll
see”.
79. Dr. Sachs tried to think of a way out of the trap, but couldn’t
find one. Roberts had stolen what little spare money Dr. Sachs had; his
freedom of speech was totally banned, so he could be jailed for
speaking out or even just being accused of speaking out; the
Times-Dispatch had
deceived the entire country and all the lawyers as to what the case was
really about, so there was no way Dr. Sachs could locate another
lawyer. Dr. Sachs made some calls to other lawyers, but no one would
speak to Dr. Sachs, as if knowing the horrible nature of what was
unfolding.
80. And then, one afternoon, while Dr. Sachs was at work in the
humble retail job he had at that time, Dr. Sachs got the extortion
phone
call that “settled” the case for Judge Payne and his criminal friends.
Roberts and Schulte were both on the phone on a conference call, they
didn’t even have the courage to pull off their treason in person.
Roberts
began his sales pitch. Judge Payne was very angry with Dr. Sachs,
hearing
that Dr. Sachs wanted to appeal Judge Payne’s order, and Judge Payne
was
preparing to send Dr. Sachs to jail under the order, perhaps working
with
the Times-Dispatch again, to fabricate a new piece of false evidence,
putting words in Dr. Sachs’ mouth that would be in violation of the ban
on freedom of speech. If Dr. Sachs didn’t sit quietly while the case
was
“settled” for him, he would be jailed. And anything could happen to Dr.
Sachs in jail. Roberts went on further. Roberts himself was threatened
by
Judge Payne, that Judge Payne would “make him pay” if Roberts did not
successfully
extort or manipulate Dr. Sachs into being submissive to the Cornwell
gang.
Roberts said he himself was afraid of revenge by Judge Payne. Roberts
said there would be a trial soon, a trial in which there would be a
judgment
enacted against Dr. Sachs that could not be voided by bankruptcy. If
Dr.
Sachs ever got out of jail, and he was still alive, he might never be
able to have a home or even an apartment. Roberts also said that if Dr.
Sachs didn’t “settle”, Roberts and Schulte could no longer “afford” to
represent him, and Dr. Sachs would be in jail, getting raped and likely
murdered, with no lawyer. The alternative, Roberts said, was for Dr.
Sachs
to simply stay silent while his freedom of speech was banned for the
rest
of his life, and sign two phony letters the Cornwell lawyers had
written
for Dr. Sachs to sign. “This way, you can stay alive,” said Roberts.
“What
do you want to do?” “Congratulations on a successful extortion,” said
Dr.
Sachs.
81. In the days afterwards, despite his life under threat, Dr. Sachs
maneuvered to try to leave a trail of proof of the Judge Payne –
Roberts extortion, without getting himself murdered in the process.
Through a combination of gentle reluctance to the extortion scheme,
while still seeming submissive enough to the egotistical thug Roberts,
Dr. Sachs managed to get some
of the discussion of Roberts’ extortion put into writing and passed
through Roberts’ facsimile machine with appropriate coding, to serve as
evidence
today to assist in the criminal indictment of Roberts, the Patricia
Cornwell
criminals and the impeachment of Judge Payne. Thanks to Dr. Sachs’
bravery,
this evidence is now in the hands of the FBI and US attorneys, and if
they
can overcome their political impulse to cover up for felonies and
treason
committed to benefit George Bush campaign contributor Patricia
Cornwell, we
have further evidence of not only the Roberts – Judge Payne initial
fraud with their bogus “First Amendment charity foundation”, but the
proof of the
threats of illegal jailing and murder that show felony treason against
the
US Constitution. When Dr. Sachs bravely and cleverly cross-examined
Roberts in a city of Richmond courtroom on 8 May, 2003, Roberts
admitted the documents were genuine – Roberts thus convicting himself
of treason. [Note to FBI: Transcript

82. Dr. Sachs had a final meeting with Roberts at which Roberts
elaborated the extortion scheme. Judge Payne was quoting as expressing
his demand that “There’s gonna be no f-cking appeal of MY court order,”
and Judge Payne said of Dr. Sachs, “I’ll have him in a jail cell
getting
f-cked up his ass every day, if he doesn’t go along” with submission to
the Cornwell criminals. Judge Payne reportedly stated that “I don’t
want
any trial at all here, with all the sh-t this guy could bring out about
Cornwell.” Roberts bluntly informed Dr. Sachs that “You’ll never make
it
[alive] to the Appeals Court,” and that “The Appeals Court is not gonna
do you a lot of good if you’re hanged and dead in a jail cell.” For
good
measure Roberts also re-iterated how Dr. Sachs would be raped in jail,
with the common practice of rape in the USA system of jails. “There’s a
lot of rape in jail,” Roberts solemnly intoned. Roberts informed Dr.
Sachs
he must remain totally quiet about Cornwell for the rest of his life;
totally
quiet about the legal case, and every aspect of it, and how the
settlement
was extorted; and never make any legal filings to try to recover his
rights,
or else face Judge Payne and the Times-Dispatch working together to
send Dr. Sachs to an indefinite contempt-of-court jailing, on charges
that Dr.
Sachs dared to speak. For the rest of his life, Roberts warned, Dr.
Sachs
must live in fear of being jailed and killed by Judge Payne and his
thugs,
so he better keep his mouth shut. Roberts assured Dr. Sachs that Judge
Payne
was getting ample bribes and “a nice cut of the action” via Cornwell’s
lawyer
Shumadine.
83. Roberts explained that as Dr. Sachs was allowed to remain alive, in
gratitude for not being murdered he could slowly pay Roberts many tens
of thousands of dollars plus 18 percent interest, and if Dr. Sachs ever
wrote or published anything again he needed to hand the income over to
Roberts. Roberts grinned as he talked about being invited over to
Patricia Cornwell’s house to celebrate the end of the case and enjoy
some of her fine wine
collection, saying, “I’m sure she has some very good wine!” A few days
later, to help lull Roberts into thinking that Dr. Sachs would remain
submissive
to the extortion, and in satiric reference to Roberts’ talking about
drinking
wine with Cornwell, Dr. Sachs left a cheap bottle of wine at Roberts’
office.
84. Dr. Sachs considered letting Judge Payne and Roberts jail him and
murder him, but he realized Roberts was right in pointing out that Dr.
Sachs’ murder in jail back then, would be a meaningless, anonymous
death, given how the Republican Times-Dispatch newspaper would publish
its final false story about Dr. Sachs to cover up for his murder. Dr.
Sachs
remembered the legacy of Adolf Hitler’s Holocaust victims, remembering
the
brave Jews and resistance fighters who also faced issues of life and
death
under fascism, and who remembered that it was important to try to
survive
and one day reveal the truth to the world. Dr. Sachs needed to survive,
so that today in safety in Europe, he can be telling the whole world
about
the Patricia Cornwell – Judge Payne scheme of treason, and about phony
court
proceedings, the banning of speech and journalism in the fraudulent and
corrupt USA legal system, despite its boasts about being the “land of
freedom”.
85. The illegal final order banning Dr. Sachs’ speech for the rest of
his life, is signed by Judge Payne and by his criminal thug Roberts in
the fraudulent role as Dr. Sachs’ lawyer. Of course, if Judge Payne,
Patricia Cornwell or any of their thugs continue to claim there was a
“settlement” in Judge Payne’s fraudulent court proceeding, they are
continuing to
make feloniously false claims for which they should face additional
criminal charges. According to Judge Payne and the Cornwell gangsters,
Dr. Sachs
supposedly “agreed” to a ban on his freedom of speech for the rest of
his
life, and to live perpetually in fear of being jailed and killed, his
writing
and journalism silenced, plus to pay some $100,000 USD plus 18 percent
interest to Judge Payne’s thug Roberts, and supposedly Dr. Sachs
“agreed” to all
this when Dr. Sachs had a liquid net worth of about ten cents, and
nothing
at all to lose by appealing Judge Payne’s brutally dishonest and
laughably
illegal and unconstitutional federal court order. Who is dumb enough to
believe these lies of the Patricia Cornwell gangsters?
86. As part of the final extortion in Judge Payne’s fraudulent court
proceeding, as Judge Payne’s thugs followed the horrible tradition of
Adolf Hitler and Joseph Stalin, with Dr. Sachs under direct threat of
being
illegally jailed and murdered, Dr. Sachs was ordered to sign two
fraudulent
letters. The first phony letter is a phony apology to the neo-nazi scum
Patricia Cornwell. The second phony letter is a letter claiming that
Dr.
Sachs made a voluntary agreement to ban his freedom of speech for the
rest
of his life, and that there was no extortion involved in what documents
prove
is a criminal extortion by threats of jail, torture and murder.
Cornwell’s lawyer Conrad Shumadine somehow thought these laughably
phony “Joseph Stalin Moscow show trial” letters, false and fraudulent
on their very face, would somehow cover him, in case his scheme of
bribery and treason ever came out in the open. These phony letters
clearly have about as much validity as
the phony and fraudulent “First Amendment charity foundation” of Judge
Payne
and his thug Roberts.
87. Judge Payne and his thug Roberts couldn’t resist one final
falsification of the federal court records about their scheme of
treason. About a year after the original extortion, Virginia lawyer Tom
Harlan informed Dr. Sachs that Judge Payne entered into the court
record a reward for Roberts’ extortion, whereby Judge Payne praises his
thug Roberts for the supposedly wonderful legal work he did while being
a criminal conspirator in fraud and treason.
And Roberts himself fabricated a phony piece of praise from Dr. Sachs,
where, according to Roberts, Dr. Sachs wanted to thank Roberts for his
legal work of treason and extortion as well. Judge Payne and Roberts
falsified
the court record in this way, knowing of course that Dr. Sachs is
banned
from replying, his freedom of speech outlawed wherever the USA or the
armies
of its empire hold sway. With Judge Payne and his thug Roberts so cozy
with each other, perhaps they could have a jail cell together after
Judge Payne’s impeachment.
X. Judge Payne’s Order Now
Worthless
88. George Bush’s campaign contributor Patricia Cornwell, can now
contemplate that she spent half a million dollars in a US federal court
bribery scheme, to purchase an order banning Dr. Sachs’ freedom of
speech, an order that is now worthless, with Patricia Cornwell’s own
lawyers laughing at her as a “stupid whore”. With millions of Americans
cheering him on, Dr. Sachs now tells Patricia Cornwell that she can
take the absurd wad of legal papers demanding to ban Dr. Sachs’ freedom
of speech, she
can roll it up, and shove it up her nazi butt. The neo-nazis and
fascists
like Patricia Cornwell and their sleazy lawyers need to learn more from
the history of the Adolf Hitler that they admire and imitate. They have
their brief moment of power, they can jail and ban and kill, but then
they often meet the destruction that their crimes have merited them.
89. Dr. Sachs understands that it is likely that the wealthy Patricia
Cornwell will now take her $125 million and flee the USA, and never
stand trial in the USA for her crimes. Patricia Cornwell will forever
be able to lie back in bed with her lovers, and brag to them
about how she was so powerful for a while inside the USA, she could buy
anything.
She had a US federal judge wagging his tongue and eager to “service”
her,
she had male Republican politicians sleeping in her bedroom at her
feet, and she was able to buy the ultimate crime, of felony high
treason against the US Constitution.
XI. Questions for Judge
Payne at
His Impeachment Trial
90. The impeachment trial of USA Federal Judge Robert Payne needs to be
held by the US Senate with television cameras rolling, and broadcast
around the world, as the American people applaud the disgrace and
punishment of this “judge” who supervised the sell-out of the USA
Constitution with a fraudulent Stalin-style right wing political show
trial. At Judge Payne’s impeachment trial, we can see if Judge Payne is
still the arrogant bully, grinning at the trampling of the US
Constitution. The inquiries from US Senators can include the following:
- Whether Judge Payne will be screaming at the
Senators as
well that there is “no scandal” involving Patricia Cornwell and the
lawyers she is paying and bribing
- Whether Judge Payne is still full of high praise
for the
criminal thug Thomas Roberts, and whether Judge Payne is laughing
now about the bogus and fraudulent “First Amendment charity foundation”
that he and Roberts fabricated to deceive and defraud Dr. Sachs
- Whether Judge Payne is still eager to provide
“service”
to “our dyke bitch Patricia Cornwell” as a reward for her campaign
contributions and bribes
- Whether Judge Payne is still grinning about “bending” the USA
Constitution, and supervising a scheme of fraud and treason out of the
US federal courthouse judge’s chambers
- Whether Judge Payne still is an admirer of Adolf Hitler, and still
a supporter of the Adolf Hitler policies of bookburning, banning of
speech, and threatening to illegally jail writers and journalists,
whether Judge Payne is still “sick of the godd-mn Jews”
- Judge Payne can be asked if he follows the Adolf Hitler idea that “a
big lie is better than a small one”, and if Judge Payne is still eager
to make false statements to cover up for the Cornwell gang
- The US Senators can place in front of Judge Payne’s nose the 1
February 2000 extortion letter from Patricia Cornwell and Michael
Rudell, the letter that threatens to “destroy” Dr. Sachs’ “books”, and
the Senators can ask Judge Payne if he still wants to repeat the brazen
falsehood that “Cornwell never threatened to destroy Dr. Sachs’ books”
- Judge Payne can be asked if he also wants to ban the freedom of
speech of US Senators who agree with Dr. Sachs and think that there’s
something wrong with Cornwell’s book-destroying threats and bribery
- Judge Payne can be asked if he still thinks it was wonderful that he
banned Dr. Sachs’ freedom of speech for the rest of his life, and
hired thugs who threatened to illegally jail and murder Dr. Sachs
- Judge Payne can be asked if wants to still send Dr. Sachs to “a jail
cell getting f-cked up his ass every day”, and how Judge Payne feels
other convicts would react to having a big, juicy ex-federal judge in
their prison along with them, an ex-federal judge who put the
Constitution
itself up for sale in a scheme of fraud and treason against a defendant
appearing in his courtroom
- Judge Payne can be asked how he feels about making the USA federal
court system the laughingstock of the entire world, as Judge Payne
“plays The Game” of bribery, fraud and terror.
Judge Payne had declared that there must be “no f-cking appeal”
of his illegal court order banning Dr. Sachs’ freedom of speech.
Perhaps Judge Payne should be given an impeachment trial with “no
f-cking appeal” as well.
91. Judge Payne can point out to the Senators that although the
documents and evidence certainly proved that he is involved in felony
fraud, staging a fraudulent court proceeding, acts of terror, and
treason
against the Constitution, Judge Payne can remind the Senators that he
committed all these felonies and crimes for clear right-wing political
purposes, in support of Republican campaign contributor Cornwell and
the
George Bush and other Republican election campaigns. Judge Payne can
tell
the Senators that he was just “playing The Game” with American crooked
lawyers, who were getting “big money” in bribes and fees from “our dyke
bitch Patricia Cornwell”, and he can invite the Senators to join in
providing
“service” to Cornwell, who certainly could offer additional campaign
contributions
and bribes to the Senators.
92. Judge Payne may try to use the “stupid country boy” defense
of himself, and start to claim he was manipulated and “brainwashed” by
the lawyers around him like Roberts and Shumadine. Judge Payne may try
to say that he didn’t realize all the level of fraud and bribes and
planting of false evidence and racketeering crimes swirling all around
him, Judge Payne may claim he’s a “stupid country boy”, he might say,
aw, shucks, he
was just banning a victim’s freedom of speech, he was just covering up
for nazi-style threats that were made in writing, he was just trying to
“service” a campaign contributor, Judge Payne may claim he didn’t know
about
all the other crimes that were included in the package of treason. But
if
Judge Payne is so dim not to see the criminal activity in which he was
directly
involved, too ignorant to see the plain meaning of the Constitution, he
is
certainly too ignorant to remain a federal judge.
93. Obviously there is great danger in allowing Judge Payne to remain
on the federal bench now that Judge Payne’s phony court proceeding has
been exposed. There is of course the disgrace that will attend to the
USA legal system that will attend from leaving Judge Payne in place.
Beyond that, however, Judge Payne will realize that his “mistake” was
in allowing Dr. Sachs to remain alive. Judge Payne will now realize
that the only way to really silence a writer and journalist is to kill
him. Judge Payne and his gangster thugs will realize they should have
murdered Dr. Sachs when they had the chance, and Judge Payne will
escalate his next scheme of treason into the anonymous murdering in a
jail cell that he and his thugs threatened with Dr. Sachs.
XII. USA Lawyers Afraid to
Fight
A “Crooked Federal Judge”
94. Of equal significance with the corruption and misconduct of
Judge Payne himself, is the corruption of the American legal
profession.
It is noteworthy that the state in the USA once home to Thomas
Jefferson,
is now the place where lawyers and a judge work together in treason
against the old US Constitution. Judge Payne could not be so successful
in supervision of this scheme of crimes and treason, without the
criminal collusion
and acquiescence of crooked American lawyers. Indeed, it was one of
Judge
Payne’s specific goals in banning Dr. Sachs’ freedom of speech, to
deceive
the American people and cover up for the misconduct of American
lawyers.
The story of Dr. Sachs’ long search for a lawyer to oppose the Patricia
Cornwell – Judge Payne scheme of fraud and treason, is a major part of
these tragic events, and one in which we continue to see a long series
of felony crimes being committed under Judge Payne’s protection. Judge
Payne’s treasonous attack on the Constitution, his illegal ban on Dr.
Sachs’
journalism, was specifically meant to provide advance protection for
all
felony crimes that would be committed by Judge Payne’s criminal
collaborators.
95. There is no “statute of limitations” problem in prosecuting
and indicting the felony racketeering crimes in which Judge Payne and
the Patricia Cornwell gangsters are involved, as a number of these
crimes
are rather freshly committed. In particular, the city of Richmond court
transcript of 8 May 2003, less than 12 months ago, provides a number of
counts of felony indictment of Judge Payne’s personal thug Thomas
Roberts,
in which Judge Payne’s name is extensively used by Roberts.
96. No one can say that Dr. Sachs rushed out of the USA to suddenly
denounce the American legal system. With extreme personal bravery, and
his very life under threat by Judge Payne and his thugs, Dr. Sachs
tried every resource he could from inside the USA, to try to fight this
scheme of treason from inside the USA legal system. Over a period of
many months, from the time the Judge Payne extortion was executed, to
the time he was forced to flee for his life from the USA, Dr. Sachs
devoted himself to
pursuing legal recourse in defense of the USA Constitution. In order to
fund legal work to defend freedom, Dr. Sachs intentionally became one
of
the USA’s highest wage earners, ready to pour a cash flow of several
hundred
thousand dollars into the fight to defend America’s old Constitution.
97. What Dr. Sachs discovered, however, is that in this kind of
case where a US federal judge joins with crooked lawyers in a felony
racketeering scheme, the guilt of the US federal judge establishes a
monolithic iron fist or iron curtain of corruption, and almost every
other
lawyer is afraid to confront “a crooked federal judge”. Dr. Sachs was
of course hampered by the fact that his speech was illegally banned by
Judge Payne’s illegal order that was imposed by criminal extortion, and
Dr. Sachs faced jailing and death if he dared to speak the truth to the
news media. There are no doubt a few bold lawyers who would have helped
Dr. Sachs, but with Judge Payne’s brutal ban on Dr. Sachs’ speech and
journalism, Dr. Sachs was never able to locate such brave lawyers among
the thousands of lawyers he contacted. Dr. Sachs' search for a lawyer,
was
very much like the story in the Bible about Abraham trying to find just
a
few good men in Sodom and Gomorrah - and just as in the Bible, Dr.
Sachs
searched everywhere for a good man among America's lawyers, but there
was
none to be found.
98. As Dr. Sachs contacted thousands of lawyers across America
regarding the Patricia Cornwell – Judge Payne phony court proceeding,
Dr. Sachs found that American lawyers were not overly shocked by this
scheme of
bribery, fraud and treason, despite agreement that Dr. Sachs had
conclusive
evidence and that it would be a “great and historic case” if some
lawyer
had “the balls” to represent Dr. Sachs. “That’s how The Game is
played,”
said the lawyers. Many lawyers took the time to talk with Dr. Sachs,
freely
sharing the views, perhaps speaking frankly because of their knowledge
that Dr. Sachs’ freedom was totally banned and outlawed by Judge
Payne’s
order. A number of lawyers patiently explained that even though Dr.
Sachs
now had a cash flow of several hundred thousand dollars he could spend
on
legal work, it was “career suicide” for any lawyer to try and help Dr.
Sachs.
“It’s precisely because your evidence is so strong that no lawyer is
gonna
help you,” explained one lawyer. “This is a f-cking powder keg, instant
indictments, instant impeachment of this judge. But if a lawyer helps
you,
he can never work again as a lawyer. He’ll be on all the other judges’
sh-t
list. Judges are like gangsters, they cover up for each other.” “If a
lawyer
helps you now, the other judges will screw that lawyer in every case in
the future, they’ll rig the lawyer up to be disbarred or even jailed on
contempt
of court charges, no law firm will hire him, he’ll be done, cooked, his
career
over with, other lawyers won’t even talk to him. That’s how political
it
all is.” Some junior lawyers interested in helping Dr. Sachs, were
overruled
by senior partners with their political fears. But most all lawyers
were
just instantly afraid of the politics involved in confronting a
dishonest
judge backed by the Bush government. “In terms of the American legal
system,
you’re f-cked now. Leaving the country is probably the only thing you
can
do. But for God’s sake, keep quiet about this crooked federal judge
till
after you’re over the border.”
99. Other lawyers were even more cynical and blunt. “You can forget
about some lawyer fighting for your rights. That kind of sh-t went out
with Bill Kunstler,” referring to the radical lawyer of a generation
ago. Another lawyer said, “I wish our firm was getting the bribe from
Cornwell’s lawyers. I bet that rich bitch pays pretty well!” Dr. Sachs
spent thousands of dollars on money in advertisements to hire a lawyer,
on monster.com
and in the Lawyers’ Weekly’s, advertising for a lawyer of courage to
fight
the Patricia Cornwell – Judge Payne extortion scheme. Another
explained,
“If you want to hire me to file a lawsuit against some doctor or
medical
practice or small business, I’ve got all the courage you f-ckin’ want.
I’ll sue any doctor, anytime, and I don’t care how flimsy the evidence
is.
But if you think I’m gonna go after some crooked lawyer, just because
you’ve
got complete proof he’s a criminal, and this lawyer is backed by a
godd-mn
crooked federal judge who’s running a bribery scheme with him, you can
forget
about that.” “A lawyer would be crazy to fight a crooked judge. They’re
all
crooked. A lawyer has got to think about how to play The Game here!”
Many
lawyers joked and laughed about filing bogus and flimsy lawsuits
against
the USA medical profession, but expressed their complete fear of suing
another
crooked lawyer. Another lawyer said, “It’s all a f-cking game. We
lawyers
all know the whole system is going down the drain, we’re just trying to
make
some money before the final flush.” And another, “Sure, you’ve got
conclusive
evidence, but the politics of your case are way too heavy. No f-ckin’
way
are we gonna help you.”
100. Many lawyers were extremely kind to Dr. Sachs and wished him well,
as they spoke in fear, sometimes with trembling voices, of the
corruption of America’s courts. Many lawyers said they would pray for
Dr. Sachs’ success and safety, but were too afraid to help him, fearing
the revenge of other judges and lawyers. Frequently, Dr. Sachs was told
to leave the country as his only option for freedom. Lawyers agreed
that
the threats to illegal jail and murder Dr. Sachs were realistic,
“especially
in crooked dirty Virginia”. Many lawyers predicted as well, that if Dr.
Sachs tried to fight from inside the American legal system, the Appeals
Court and other judges would conspire to cover up for Judge Payne. “If
the American people found out how crooked the judges really are, the
whole
house of cards will start to crumble,” said one lawyer.
101. For a number of lawyers, the key fact in the American legal
landscape was how the higher courts would not take steps to reverse the
election ambiguities in the year 2000, which appeared to have a much
greater impact on USA lawyers than they did on the American people.
Some lawyers said that America’s higher courts, even though the judges
saw the election as fraudulent, the judges made a political decision to
accept election fraud so as not to de-stabilize the American people’s
image of their government. Some lawyers explained to Dr. Sachs that the
political extortion he experienced in Judge Payne’s courtroom, was just
another event in the take-over of America by the extreme right wing.
“So even though the other judges know that Judge Payne is violating the
Constitution and taking bribes from Cornwell, they’ll cover up for
Payne, and they’ll go ahead and let you be jailed and killed, rather
than admit to the American people how crooked the court system is. It’s
just like the stolen election. The judges think that deceiving the
American people is just the safer political idea, even though the wrong
guy gets to be president, and little guys like you get f-cked over and
shut
up and maybe jailed and killed.” Another lawyer bluntly told Dr. Sachs,
“You’re living in a country where the godd-mn f-cking President stole
the
election from the other guy. What the f-ck makes you think you can get
your
own freedom back?”
XIII. Judge Payne’s Thug
Harasses Dr. Sachs for Money
102. As Dr. Sachs pursued his quest for a lawyer to fight this scheme
of treason, Judge Payne’s criminal thug Roberts began to harass Dr.
Sachs for money for the alleged “legal services” in getting Dr. Sachs’
freedom of speech banned for the rest of his life. In early 2001,
Roberts sent a letter dunning Dr. Sachs for money. Dr. Sachs cleverly
replied,
gently talking about the bribe Roberts got from Cornwell’s lawyers, and
satirically asking about Roberts deducting the bribes from Dr. Sachs’
purported
legal bill. Roberts replied in writing, not even trying to deny he got
bribes, and showing himself to be a guilty criminal, still hoping to
squeeze
some money out of Dr. Sachs. The correspondence record shows Roberts
implicitly admitting he was in a bribery relationship with Cornwell’s
Willcox & Savage law firm.
103. In mid-2001, Dr. Sachs located the first lawyer who seemed
willing to fight the Patricia Cornwell scheme of treason, only to have
him successfully frightened off by Roberts. Dr. Sachs got a positive
reply from libel lawyer Tom Harlan of Norfolk, Virginia. Harlan was
particularly
interested in the way that the Times-Dispatch had fabricated false
evidence
for a US federal court case, and declared he knew Cornwell’s lawyer
Shumadine was a “sleazebag” and would have no trouble facing him. But
as Dr. Sachs was driving to see Harlan, Harlan talked to Roberts, and
Roberts succeeded in terrifying Harlan, with Roberts talking about how
he was fully backed by Judge Payne and the US George Bush government,
and Harlan had better back off from helping Dr. Sachs. Dr. Sachs
arrived in Harlan’s office to find Harlan trembling with fear, and
suddenly declaring that he “doesn’t go on crusades against crooked
federal judges”, and Harlan suddenly claiming he “didn’t understand”
what the case was all about and that Dr. Sachs should pick up his
papers and leave.
104. Shortly after the September 11 attack on America, Roberts sent
another dunning letter to Dr. Sachs. This time, Dr. Sachs replied
forcefully, indicating he was lining up lawyers to sue Roberts and
request his criminal indictment. Roberts then began to lay low for a
while, until in spring of 2002, Roberts realized through the lawyers’
grapevine that Dr. Sachs was still searching for a lawyer and could not
find anyone to face down the Roberts - Judge Payne – Patricia Cornwell
extortion scheme. So in May 2002, Roberts filed a debt collection
lawsuit against Dr. Sachs, realizing that no one had surfaced to
protect Dr. Sachs.
XIV. Felony Fraud by Scott
Ives
and Tate & Bywater
105. Dr. Sachs connected with a lawyer in Northern Virginia, Scott Ives
of the Tate and Bywater firm, who claimed he would be “aggressive” in
fighting Thomas Roberts and would be filing countersuits against him.
Scott Ives, who is Jewish, claimed he very much sympathized with Dr.
Sachs’ anti-Nazi views and the need to honor victims of the Holocaust,
and fight the kind of fascist oppression of the Patricia Cornwell –
Judge Payne extortion scheme. Ives vowed that for $50,000 US dollars
from Sachs – a figure that Dr. Sachs could gradually supply with his
new income – that Ives could “blow open” this whole scandal, and win
back for Dr. Sachs his freedom to speak. So Dr. Sachs signed a contract
with the Tate & Bywater firm, and
gave money to Scott Ives and Tate & Bywater.
106. Then, Scott Ives talked to Thomas Roberts, and was successfully
induced to join in the Cornwell racketeering scheme, and to betray Dr.
Sachs. Ives would later acknowledge that Roberts was able to say
something to Ives that made him feel it was better to defraud and
betray Dr. Sachs, rather than dare fight Roberts. Scott Ives’
“representation” of Dr. Sachs became a mini-replay of the Roberts
extortion. Ives began to put in writing his false lying claims that it
wasn’t possible to file any kind of countersuit or lawsuit against
Roberts, Ives told Dr. Sachs he would need to work out paying money to
Roberts, and that keeping the fraudulent Ives “on the
case” would help prevent Dr. Sachs from being jailed. So, having
invested money with Ives and Tate & Bywater to expose the Roberts
extortion scheme, Dr. Sachs was now stuck with a new lawyer who had
defrauded him, with a new claim that he needed to keep this phony
lawyer in place to avoid being jailed. Dr. Sachs kept up the search for
a new lawyer while leaving the fraudulent Scott Ives nominally in
place, in submission to the extortion threat that he might be jailed if
he fired Scott Ives.
107. Dr. Sachs made contact with another lawyer, Dan Press of Chung
& Press of McLean, Virginia, in late 2002. Dan Press began a long
flirtation of many months with Dr. Sachs, in which Dan Press considered
the possibility of helping Dr. Sachs to sue Thomas Roberts and defend
the US Constitution. Press spoke boldly of suing Roberts and going into
federal court to defend Dr. Sachs’ right to engage in journalism.
However,
after Dan Press had a brief conversation with Judge Payne’s thugs, Dan
Press
began a gradual process of withdrawal from Dr. Sachs. Dan Press and his
Chung & Press law firm finally decided that their firm would have a
brighter future if they did not help Dr. Sachs, and so they also
abandoned
him to face Judge Payne’s thugs without any legal help. Dan Press at
least
never defrauded Dr. Sachs out of any money.
108. Various legal nonsense went on for a number of months with
Roberts and Scott Ives, until finally Scott Ives told Dr. Sachs flat
out in February 2003 that he was abandoning Dr. Sachs altogether,
because
of Dr. Sachs’ desire to speak the truth and defend the Constitution.
Dr.
Sachs’ approached the other partners of the Tate & Bywater law firm
about Scott Ives’ fraud and betrayal, but Tate & Bywater endorsed
the
criminal abandonment and defrauding of Dr. Sachs by Scott Ives.
XV. Felony Fraud by James
["Jim"] Magner
of Virginia Beach
109. As Dr. Sachs continued to contact thousands of lawyers by letter
and e-mail, and advertise widely for a lawyer to help him fight the
Cornwell gang of criminals, Dr. Sachs became increasingly targeted by
lawyers who sought to defraud Dr. Sachs out of money, while having no
intention of representing Dr. Sachs. Very typically, this type of fraud
took the form of a lawyer asking for Dr. Sachs for a sum of money,
amounts between $200 and $50,000 USA dollars, without an offer of
representation, but merely for “research and review of the legal
issues” and the writing up of a “memorandum”. Dr. Sachs was able to see
through most of these criminal schemes, and
one cynical lawyer even admitted, laughing, that he had no intention of
actually fighting for Dr. Sachs, he was just trying to rob Dr. Sachs of
money.
110. Before the end, however, Dr. Sachs was defrauded by one more
lawyer, James P. Magner of Virginia Beach, Virginia, in a criminal
fraud that was exceptionally blatant and brutal, with Magner being
perhaps
a direct plant of the Cornwell gang. Magner responded to Dr. Sachs’
advertisement, and invited Dr. Sachs to Virginia Beach, Virginia, for a
meeting that lasted several hours. Magner promised an aggressive fight
against Roberts, and
countersuits to be filed against him, and exposure of Roberts’ criminal
fraud and extortion. Shortly after the meeting, Dr. Sachs signed a
contract with Magner, a contract which clearly stated “This is signed
in good faith that James Magner is indeed willing to fight . . .
against the gross wrongdoing, malpractice, breach of contract and
extortion offenses by the dishonest attorney
Tom Roberts”, and sent Magner $5,000 in checks with the signed contract
in an overnight envelope.
111. Magner cashed the $5,000 in checks, and within a matter of
mere hours after the checks had cleared the bank, Magner sent Dr. Sachs
a series of ugly, abusive, obscene and offensive late night e-mails,
that seemed written by a cocaine addict, in which Magner declared that
he had no intention of honoring the contract he had just signed, that
he wanted Dr. Sachs to start being submissive to the claims of the
Cornwell criminals, and that he was keeping the entire sum of $5,000
even though he was not honoring the contract. Magner also began
threatening Dr. Sachs to keep quiet about the fraud, or else Magner
would be taking legal action against Dr. Sachs. Magner was taking clear
advantage of the situation that, in Virginia, lawyers will generally
not sue other crooked lawyers; and that Dr. Sachs’ freedom of speech
was banned, so Dr. Sachs couldn’t go public with the complaint about
Magner; and that Dr. Sachs was already unable to find legal help
against anyone involved with the Patricia Cornwell – Judge Payne fraud
scheme, and Dr. Sachs faced jail and murder if he didn’t keep his mouth
shut, so Magner felt he could also get away with defrauding Dr. Sachs
out of money.
XVI. Virginia Police Back
the
Patricia Cornwell Criminals
112. Also significant in the Patricia Cornwell – Judge Payne scheme of
treason, is how the police and law enforcement agencies of Virginia
also joined in these felony crimes, in threatening Dr. Sachs and in
obstruction of justice, out of consideration for Patricia Cornwell’s
backing of leading Virginia politicians like former Republican Governor
Jim Gilmore who resided in the bedroom of Patricia Cornwell’s mansion.
With the amazingly brazen felony fraud by James Magner, Dr. Sachs took
the brave step of starting to notify the police and law enforcement
agencies of these crimes. Starting with the felony fraud by the lawyer
James Magner, Dr. Sachs sent letters to police agencies, and Dr. Sachs
got a call of positive interest from Detective Swan of the Virginia
Beach Police Department, and Dr. Sachs mailed to Detective Swan an
extensive evidence file he could use to bring criminal charges against
James Magner as well as others.
113. Then, however, Detective Swan had a highly political conference
with the Virginia Beach district attorney’s office, where Detective
Swan learned that Dr. Sachs was trying to fight corruption in Virginia,
and that Dr. Sachs was opposed by the powerful good ol’ boy
establishment. Detective Swan was instructed to do nothing about the
crimes being committed against Dr. Sachs and to join in the
intimidation of Dr. Sachs. Detective Swan
then made some hostile phone calls to Dr. Sachs, extremely Gestapo-like
in nature, where Dr. Sachs was informed that the police would be
“backing up” the fraud by Magner and others, Dr. Sachs was ominously
warned to “stop trying to fight Patricia Cornwell” and was also warned
that Dr. Sachs “better pay up to these lawyers or face the
consequences.” Dr. Sachs was told as he was getting a partial refund
from Magner, although Magner, according to
Detective Swan, now had “every right” to keep “his share” of the $5,000
he
had defrauded out of Dr. Sachs, and the police didn’t want “any more
trouble” from Dr. Sachs. Detective Swan then committed the crime of
disposing of the evidence in his hands, evidence of the criminal felony
activity of James Magner and others, so as to pretend he hadn’t seen
it. Dr. Sachs received letters from other agencies indicating
non-action about the crimes and felonies being committed against him.
XVII. Virginia State Bar
Joins
in Obstruction of Justice
114. Another agency with full criminal guilt in the Patricia Cornwell –
Judge Payne scheme of fraud and treason, is the Virginia State Bar,
the official agency charged with dealing with ethics crimes by Virginia
lawyers. The Virginia State Bar has a longstanding reputation for
wholesale
corruption and racism, going after radical black lawyers, while
covering
up for crooked white lawyers who commit major felony crimes but are
connected
to the good ol’ boy Virginia establishment. Early on, the Virginia
State
Bar took an active role in supporting the Patricia Cornwell – Judge
Payne
scheme of fraud and treason.
115. The Virginia State Bar took an active role in trying to prevent
Dr. Sachs from finding a lawyer. The ladies working the Virginia State
Bar lawyer referral line were trying to help Dr. Sachs find a lawyer,
but of course the names they gave to Dr. Sachs turned out to be lawyers
too
afraid to confront a criminal scheme in which US Federal Judge Payne
was
a participant. When the ladies sought help from their superiors, they
were
informed that they must not give Dr. Sachs the names of any lawyers,
and
they were instructed to hang up the phone on Dr. Sachs’ ear when he
called
them, ignoring Dr. Sachs’ polite requests for help in locating a lawyer
of courage.
116. In his final weeks at his old Virginia residence, Dr. Sachs, with
immense personal courage, actually confronted the Virginia Bar with the
crystal clear evidence with which they could institute disbarment
proceedings against Roberts and Magner – the phony fraudulent “First
Amendment
charity foundation”, and Magner’s fraud that he carried out in writing.
Dr. Sachs also pointed out that the proven crimes and offenses of James
Magner, were identical to crimes with which the bar had recently
charged
radical black lawyer Sa’ad El-Amin.
117. The Virginia Bar made clear in several letters, however, that that
would deal completely differently with the same offense when charged to
a radical black lawyer, versus a white lawyer like Magner or Roberts
who was part of the good ol’ boys. The Virginia State Bar made clear
that, in light of the fact this whole criminal scheme was backed by US
Federal Judge Robert Payne, on behalf of campaign contributor Patricia
Cornwell, the Virginia State Bar would cover up for any and all crimes
committed by white lawyers to assist Patricia Cornwell and Judge Payne
and their lawyers. The Virginia State Bar would just sit back and laugh
while lawyers like James
Magner defrauded Dr. Sachs, and would laugh while any other lawyers
defrauded Dr. Sachs, too. The Virginia State Bar also noted that Judge
Payne had
banned Dr. Sachs’ freedom of speech for the rest of his life, so they
thought
that no one could ever find out about these multiple fraud schemes by
Virginia’s
white lawyers.
XVIII. Dr. Sachs’ Last
Brave
Stand Inside the USA
118. Totally abandoned by America’s cowardly and crooked lawyers,
despite many thousands of dollars spent on legal fees and advertising
for lawyers, and with immense personal courage, Dr. Sachs made one,
extremely brave, final stand to try and defend the US Constitution from
within the USA. On 8 May 2003, in a city of Richmond, Virginia
courtroom, Dr. Sachs, with personal bravery that astonished his close
friends, confronted Judge Payne’s criminal thug Thomas Roberts, in the
civil case where Roberts
was suing Dr. Sachs for money, in regard to Roberts’ criminally
fraudulent
actions posing as Dr. Sachs’ lawyer, and Roberts’ threats of jail and
murder
and banning Dr. Sachs’ freedom of speech for the rest of his life.
119. In a brave and bravura performance, Dr. Sachs put Roberts on the
witness stand and cut him to pieces, cross-examining him and exposing
his felony crimes and fraud and perjury, with ample documents for the
judge that were entered into the court record. With an impassioned and
tearful summary, Dr. Sachs summarized Roberts’ crimes of extortion,
fraud,
bribery and treason against his client and against the USA
Constitution. Dr. Sachs was so effective, that Roberts’ lawyer, Murphy
Pepper, had no
reply at all to the evidence and summary of his client’s criminal
misconduct.
For this hearing, Dr. Sachs hired a stenographer, and this transcript
is
available today to the FBI and Special Prosecutor to bring additional
felony
charges against Roberts and the whole Patricia Cornwell – Judge Payne
gang
of criminal thugs. If the FBI is not “too busy”, they can stop and see
Patricia
Ray of Crane-Snead & Associates on Fitzhugh Avenue in Richmond, and
obtain this transcript to bring multiple felony charges against Roberts
and his gangsters.
120. At the end, the judge in the case, Judge Joi Taylor, did not deny
that Dr. Sachs had successfully proven that Roberts had committed
felony fraud and extortion against his client. But Judge Taylor could
also see that Roberts, who had been throwing around Judge Payne’s name,
was backed by powerful people in Virginia, and as a black female judge
she was in need to look out for her own career, and not end up like
other
black judges who were railroaded out of office. Judge Taylor could also
see that there was no media present in the court room, given that Dr.
Sachs’
freedom of speech was already banned for the rest of his life, so she
could go ahead and give judgment for Roberts, make the good ol’ boys
happy,
take care of her own career, and she could feel no one would ever find
out about it. Judge Taylor thus declared that, despite the evidence
that
Roberts was a felony criminal fraud and extortionist, she was declaring
victory for Roberts, and Dr. Sachs should begin paying to Roberts on
the
$100,000 plus 18 percent interest that Roberts claimed, with an initial
judgment
for about ten percent of that amount, and Roberts could sue for the
rest
later.
121. A few days after Dr. Sachs had been brave enough to speak the
truth in court, Judge Payne's thugs called Dr. Sachs on the phone and
screamed, “You’re going to jail, Motherf-cker!” Dr. Sachs abandoned his
old home and began making his way to exile, to find freedom at last
beyond the USA’s borders, to finally be able tell the truth to other
Americans, about phony court proceedings, fraud, bribery and treason,
in America’s crooked courts.
XIX. Is There Any Hope for
America, Or Is It Too Late?
122. Every American and the people of every nation, needs to know about
the Patricia Cornwell – Judge Payne treason scheme, the corruption and
failure of the American legal system, and the greed and cowardice
of American lawyers. The question now that remains is: Is there any
hope
for the USA legal system, or is it already too late, the dark night of
fascism and corruption already setting upon a right-wing USA empire?
Should
the corruption in Judge Payne’s Virginia for George Bush contributor
Patricia Cornwell, be understood as fully illustrating the new America?
Is it now like the quick shift from the democracy of Weimar to Hitler’s
Nazi Reich?
123. Dr. Sachs accepts that his life in the old USA is now over. With
Judge Payne and his brutal criminal thugs threatening to jail and
murder Dr. Sachs for speaking the truth, Dr. Sachs accepts that he can
best help his former fellow Americans by speaking out about USA legal
corruption from safety abroad, in countries where freedom genuinely
still lives.
124. In the hope that there will be some hope for Americans in having
some relief of legal corruption, Dr. Sachs grants to the Special
Prosecutor and FBI the complete transfer of his personal legal files
and filings
and e-mails and every other document that they can collect from the law
offices of the extortionist Thomas Roberts, the crooked lawyer Scott
Ives
and Tate and Bywater, the crooked lawyer James Magner, and the Virginia
State Bar, these files to begin the series of criminal indictments of
all
these and other criminal thugs and the impeachment of Judge Robert
Payne.
The Appeals Court is also invited to suggest what to do with Judge
Payne’s
obscenely unconstitutional order that he imposed by his thugs
threatening
to jail and murder Dr. Sachs. Now that Dr. Sachs has escaped from the
USA
and the arena of Judge Payne's power, the order no longer affects him,
but
the order should be voided for the good of the American people and in
protection of their old Constitution.
125. The FBI and US Attorney already have sufficient documents for the
immediate arrest of Judge Payne’s thug Roberts, and other criminals as
well, but Dr. Sachs recognizes that the lower level employees of the
Justice Department may have been hiding this material from their
superiors “because Ashcroft won’t like it”, because these crimes and
felonies will lead to the embarrassment of the George Bush government
and Bush campaign contributor Cornwell. If the FBI and US Attorney have
“misplaced” the information in their hands, they may easily re-assemble
it from the above sources, plus the files at the US Federal Courthouse
and the city of Richmond courthouse. If the George Bush government
continues to supervise a cover up of the crimes connected with Bush
campaign contributor Cornwell and Judge Payne, then hopefully there
will be a new government which will pursue the criminal indictments and
impeachments that the American people deserve to have of these
gangsters. May God bring quick relief and peace to all those who suffer
from tyranny and injustice.
